FINANCIAL OBLIGATIONS. <br /> <br />(1) San Marcos is responsible for the hiring and paying <br />of the following services: <br /> <br />(a) Appraisal, environmental and land planning <br />consultants. <br /> <br />(b) Surveying and geotechnical services. <br /> <br />(c) ~~y legal services, whether eminent domain or <br />other type. <br /> <br />(2) San Harcos is also responsible for having <br />sufficient funds available for the purchase of the <br />tracts of land associated with the water treatment <br />plant. San Marcos is responsible fÐr the timely <br />deposit of funds required for the acquisition of <br />any properties under this Agreement. <br /> <br />(3) San Marcos is responsible for the designation of a <br />title company acceptable to San Marcos for closing. <br /> <br />(4) San Marcos will serve as the contracting and <br />coordinating agency. <br /> <br />C. REVIEW OF ACQUISITIONS. San Marcos is responsible for <br />reviewing the appraisals and setting negotiating <br />parameters for all offers made to property owners by <br />Austin on behalf of San Marcos. San Harcos will define <br />for Austin any limits in the expenses authorized to be <br />negotiated, including any relocation expenses. <br /> <br />D. LEGAL REVIEW. San Marcos is responsible for providing all <br />legal documents, contracts, offers, closing documents, <br />and other legal instruments associated with the <br />acquisition of the property.
