<br /> ~~ <br /> (h) hold an annual public hearing to review the zoning <br /> ordinance; and <br /> (i) perform such other duties and be vested with such other <br /> powers as the city Council may prescribe. <br /> ARTICLE III <br /> MEMBERSHIP, TERMS, QUORUM, ATTENDANCE <br /> Section 1. The Planning and Zoning Commission shall consist of <br /> nine (9) members appointed by the City Council. At least eight (8) <br /> members shall be residents of and own real property in the city, <br /> and one (1) member may be a resident of and own real property <br /> within the extraterritorial jurisdiction of the city. Members of <br /> the Commission shall serve without compensation. <br /> Section 2. Each Commission member serves a three (3) year term. <br /> Terms are staggered so that three (3) of the members' terms expire <br /> in any given year. Terms expire on the last day of September. <br /> Commission members shall be eligible to serve a maximum of two (2) <br /> full terms. If a person is appointed to fill an unexpired term of <br /> more than eighteen (18) months, the person will serve the remainder <br /> of that term and shall be eligible for reappointment for no more <br /> than one full term. If a person is appointed to f~ll an unexpired <br /> term of less than eighteen (18) months, the person shall be <br /> eligible for reappointment for no more than two full terms. <br /> Section 3. A quorum shall be no less than five (5) members. No <br /> business shall be conducted or actions taken without a quorum of <br /> the membership present except to recess and set time and date of <br /> next meeting. <br /> Section 4. The voluntary absence of a Commission member from three <br /> consecutive meetings shall result in the automatic resignation of <br /> the member. The absence of a member may be regarded as excused <br /> rather than voluntary at the sole discretion of the Chair if the <br /> absence resulted from illness or a factor beyond the control of the <br /> member. An excused absence shall be reported to the Recording <br /> Secretary of the Commission no later than 5 p.m. on the day of the <br /> meeting. An absence that is not reported to the Recording <br /> Secretary is presumed to be voluntary. The Vice-Chair or presiding <br /> officer shall rule regarding the absence of the Chair. The Chair <br /> or presiding officer is to forward to the city Secretary the name <br /> of any member who is voluntarily absent from three consecutive <br /> meetings. <br /> Section 5. Members shall not represent themselves or any other <br /> person, group or interest before the Zoning Board of Adjustments <br /> and Appeals or the city council on any matter involving land use or <br /> development. This provision shall not preclude a member from <br /> representing an interest in his or her homestead. Members may <br /> represent the Commission in reporting on the activities of the <br /> 2 <br />
