<br /> S-f£ <br /> by the Contract Documents and for the operation, use and <br /> maintenance of the proj ect, and that the County will cooperate <br /> with SMCISD in performing the services as Project Manager that <br /> SMCISD has agreed to perform hereunder <br /> 4.04 The County warrants that it has the full power and <br /> authority to enter into this Agreement and fulfill its <br /> obligations hereunder, and that it has funds readily available <br /> from current revenues to meet its obligations under this <br /> Agreement and that it will pay its obligations under this <br /> Agreement from current revenues. <br /> 4.05 The County represents, warrants and agrees that it will <br /> promptly and timely pay to the SMCISD, the County's share of <br /> all costs and expenses to be paid under the terms of this <br /> Agreement. . <br /> 4.06 The County hereby represents and warrants that the <br /> Commissioner's Court for the County has given specific written <br /> approval for the construction of the Project and that the <br /> County has complied with the terms and provisions of Section <br /> 791.014 of the Texas Government Code and that the approval <br /> given by the Commissioner's Court has been given in writing in <br /> a document other than this Agreement, and that the written <br /> authorization and approval describes the type of proj ect to be <br /> undertaken, the Project's location and the amount to be <br /> contributed toward the construction of the Project by the <br /> County. <br /> -6- <br /> INTBRLOCAL AGRBBMBNT FOR ROADWAY IMPROVEMBNTS <br />
