Regular Meeting May 1, 2007 Page 6 <br />Motion to amend failed. Mr. O'Leary stated Duane Tegrotenhouse has meet <br />with the Parks Department and he has requested the Ordinance be stricter a <br />include river clean up. Mayor Narvaiz stated since our concern is safety <br />then Council should adopt this Ordinance and bring it back in a year to <br />address any changes. The Council agreed to bring back the Ordinance before <br />the 2008 season for review. The Council then voted unanimously for adoption <br />of the Ordinance on third and final reading. <br />Mayor Narvaiz introduced for consideration Item 16, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY AND BYRN <br />& ASSOCIATES, INC. FOR PROFESSIONAL SURVEYING AND PLATTING SERVICES IN <br />CONNECTION WITH THE TEXAS HOME PARTNERSHIP GRANT PROGRAM; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY AND <br />DECLARING AN EFFECTIVE DATE. <br />Mr. Jones moved for adoption of the Resolution, and Mr. Guerrero seconded <br />the motion. Ms. Robertson inquired to where the funding was coming from. <br />Janis Hendrix, Community Development Coordinator, stated the funding is <br />through the Texas Department of Housing (HOME Grant) and she realizes the <br />wording in the agreement did not reflect that. Mr. Quittner stated he will <br />get that corrected. The Council then voted unanimously for adoption of <br />Resolution. <br />Mayor Narvaiz introduced for consideration Items 22 and 23, removed from <br />the consent agenda, adoption of Resolutions, captions read as follows: <br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />CONDITIONALLY APPROVING THE DRAFT LEASE OF A TRACT OF LAND AND FUEL <br />STORAGE TANKS AT THE SAN MARCOS MUNICIPAL AIRPORT TO JFA, LLP <br />CONTINGENT UPON NECESSARY INFORMATION BEING OBTAINED; AND DECLARING AN <br />EFFECTIVE DATE. <br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF <br />OBLIGATION; AND OTHER MATTERS RELATED THERETO. <br />Mr. Jones moved to table Items #22 and 23, adoptions of Resolutions, and <br />Mr. Guerrero seconded the motion, which passed unanimously. <br />Mayor Narvaiz introduced a public hearing and consideration for approval of <br />Ordinance on first reading, the caption which was read as follows: <br />
