Mr. O'Leary stated Duane Tegrotenhouse has meet with the Parks Department and he has requested the Ordinance be stricter a include river clean up. Mayor Narvaiz stated since our concern is safety then Council should adopt this Ordinance and bring it back in a year to address any changes. The Council agreed to bring back the Ordinance before the 2008 season for review. The Council then voted unanimously for adoption of the Ordinance on third and final reading. Mayor Narvaiz introduced for consideration Item 16, removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY AND BYRN & ASSOCIATES, INC. FOR PROFESSIONAL SURVEYING AND PLATTING SERVICES IN CONNECTION WITH THE TEXAS HOME PARTNERSHIP GRANT PROGRAM; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. Mr. Jones moved for adoption of the Resolution, and Mr. Guerrero seconded the motion. Ms. Robertson inquired to where the funding was coming from. Janis Hendrix, Community Development Coordinator, stated the funding is through the Texas Department of Housing (HOME Grant) and she realizes the wording in the agreement did not reflect that. Mr. Quittner stated he will get that corrected. The Council then voted unanimously for adoption of Resolution. Mayor Narvaiz introduced for consideration Items 22 and 23, removed from the consent agenda, adoption of Resolutions, captions read as follows: A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CONDITIONALLY APPROVING THE DRAFT LEASE OF A TRACT OF LAND AND FUEL STORAGE TANKS AT THE SAN MARCOS MUNICIPAL AIRPORT TO JFA, LLP CONTINGENT UPON NECESSARY INFORMATION BEING OBTAINED; AND DECLARING AN EFFECTIVE DATE. A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION; AND OTHER MATTERS RELATED THERETO. Mr. Jones moved to table Items #22 and 23, adoptions of Resolutions, and Mr. Guerrero seconded the motion, which passed unanimously.
