Regular Meeting May 1, 2007 Page 7 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND <br />CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY TEXAS GAS <br />OPERATIONS., ITS SUCCESSORS AND ASSIGNS, THE RIGHT, PRIVILEGE AND <br />FRANCHISE FOR A PERIOD OF FIVE (5) YEARS FOR THE CONSTRUCTION, <br />MAINTENANCE AND OPERATION OF NATURAL GAS DISTRIBUTION SYSTEM IN THE <br />CITY OF SAN MARCOS, HAYS COUNTY, TEXAS; PROVIDING CONDITIONS <br />CONTROLLING THE USE BY CENTERPOINT ENERGY RESOURCES CORP. DBA <br />CENTERPOINT ENERGY TEXAS GAS OPERATIONS OF PUBLIC PROPERTY <br />ESTABLISHING STANDARDS OF SERVICE; PROVIDING FOR PAYMENT OF FRANCHISE <br />FEES BY CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY <br />TEXAS GAS OPERATIONS TO THE CITY; PROVIDING FOR ACCEPTANCE; PROVIDING <br />FOR SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. <br />Karl Burris, Centerpoint Energy, stated he was available to answer any <br />questions the Council might have. No one else wished to speak, so Mayor <br />Narvaiz closed the public hearing. Mr. Guerrero moved for approval of <br />Ordinance on first reading, and Ms. Couch seconded the motion. Mr. O'Leary <br />stated this is a franchise agreement to allow Centerpoint the use of our <br />streets and to provide natural gas to the citizens of San Marcos. He stated <br />this agreement will allow Centerpoint to receive a franchise fee of 30 of <br />their gross receipts. Mayor Narvaiz stated she does not feel that <br />Centerpoint provides a high quality of service for their San Marcos users. <br />She stated she feels Section 11 need to be reviewed closer and there needs <br />to be a local office to accept payments. She stated her personal experience <br />she has been that she was treated rudely and has found long gaps in billing <br />cycles. Mr. Jones stated he has had some of the same problems with <br />Centerpoint. He also stated he has received several complaints from <br />citizens regarding the same issues. Mr. O'Leary suggested the Council table <br />this Ordinance until he can address these concerns with Centerpoint. Mr. <br />Burris stated he is embarrassed about the comments regarding their customer <br />service. He stated he would be happy to meet with Staff to address these <br />issues. Mr. Guerrero moved to table the Ordinance, and Mr. Jones seconded <br />the motion, which passed unanimously. <br />Mayor Narvaiz introduced a public hearing and consideration of adoption <br />Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAROCS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM "I" INDUSTRIAL <br />TO "P" PUBLIC AND INSTITUTIONAL, FOR A 3.994 ACRE, MORE OR LESS, TRACT <br />OF LAND LOCATED AT 201 RIVER RIDGE PARKWAY; FOR AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "LI" LIGHT <br />INDUSTRIAL DISTRICT TO "P" PUBLIC AND INSTITUTIONAL DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />
