Regular Meeting May 1, 2007 Page 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY TEXAS GAS OPERATIONS., ITS SUCCESSORS AND ASSIGNS, THE RIGHT, PRIVILEGE AND FRANCHISE FOR A PERIOD OF FIVE (5) YEARS FOR THE CONSTRUCTION, MAINTENANCE AND OPERATION OF NATURAL GAS DISTRIBUTION SYSTEM IN THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS; PROVIDING CONDITIONS CONTROLLING THE USE BY CENTERPOINT ENERGY RESOURCES CORP. DBA CENTERPOINT ENERGY TEXAS GAS OPERATIONS OF PUBLIC PROPERTY ESTABLISHING STANDARDS OF SERVICE; PROVIDING FOR PAYMENT OF FRANCHISE FEES BY CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY TEXAS GAS OPERATIONS TO THE CITY; PROVIDING FOR ACCEPTANCE; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EFFECTIVE DATE. Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. Karl Burris, Centerpoint Energy, stated he was available to answer any questions the Council might have. No one else wished to speak, so Mayor Narvaiz closed the public hearing. Mr. Guerrero moved for approval of Ordinance on first reading, and Ms. Couch seconded the motion. Mr. O'Leary stated this is a franchise agreement to allow Centerpoint the use of our streets and to provide natural gas to the citizens of San Marcos. He stated this agreement will allow Centerpoint to receive a franchise fee of 30 of their gross receipts. Mayor Narvaiz stated she does not feel that Centerpoint provides a high quality of service for their San Marcos users. She stated she feels Section 11 need to be reviewed closer and there needs to be a local office to accept payments. She stated her personal experience she has been that she was treated rudely and has found long gaps in billing cycles. Mr. Jones stated he has had some of the same problems with Centerpoint. He also stated he has received several complaints from citizens regarding the same issues. Mr. O'Leary suggested the Council table this Ordinance until he can address these concerns with Centerpoint. Mr. Burris stated he is embarrassed about the comments regarding their customer service. He stated he would be happy to meet with Staff to address these issues. Mr. Guerrero moved to table the Ordinance, and Mr. Jones seconded the motion, which passed unanimously. Mayor Narvaiz introduced a public hearing and consideration of adoption Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAROCS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM "I" INDUSTRIAL TO "P" PUBLIC AND INSTITUTIONAL, FOR A 3.994 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 201 RIVER RIDGE PARKWAY; FOR AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "LI" LIGHT INDUSTRIAL DISTRICT TO "P" PUBLIC AND INSTITUTIONAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES.
