<br />PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br /> <br />This Agreement is made this the 19th day of June , 2007, between the City <br />of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Alan Plummer <br />Associates, Inc. 6300 La Calma, Ste. 400, Austin, Texas 78752 ("Engineer") for the provision of <br />services in connection with the Cottonwood Creek Elevated Storage Tank Project (the <br />"Project"). <br /> <br />The City and the Engineer agree as follows: <br /> <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1.1.1 Engineer will be responsible for the proper, accurate and adequate design and <br />preparation of drawings and specifications and other construction documents and for <br />construction administration for the Project. The Project generally includes the construction of a <br />one million gallon elevated storage tank to be located along SH 123 approximately 5,000 feet <br />south of the intersection with Old Bastrop Highway. The Project is intended to serve the southern <br />portions of the City of San Marcos. It is anticipated that the tank will be of composite <br />construction with a standard concrete base and steel tank for storing the water. The Engineer <br />will include necessary site improvements for proper access, drainage, and security for the site. In <br />addition, telemetry will be provided by the Engineer in order to link the tank to the City's <br />SCADA system. Finally, the piping necessary to connect the tank to the City's distribution <br />system will be included by the Engineer. It is anticipated that this will be limited to less than 500 <br />feet of pipe. The tank manufacturer will be responsible for the structural design of the tank and <br />foundation. <br /> <br />1.1.2 The Engineer's Basic Services consist of the services described in Sections 1.1 through 1.3 <br />and include normal civil engineering services as well as those engineering services to be <br />performed through the following consulting disciplines as subcontractors to the Engineer: <br /> <br />(1) Professional Services Industries, Inc. - Geotechnical Engineering <br /> <br />1.1.3 The performance of all services by the Engineer in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines. In performing all services under this Agreement, the <br />Engineer will use that degree of care and skill ordinarily exercised for similar projects by <br />professional Engineers who possess special expertise in the types of services involved under this <br />Agreement. <br /> <br />1.1.4 No work under this Agreement will be subcontracted by the Engineer without prior <br />written approval from the City. Any work or services subcontracted under this Agreement shall <br />be specified by separate written Agreement and shall be subject to each provision of this <br /> <br />AP AI Elevated Storage Tank <br /> <br />1 <br />
