RESOLUTION 2012 -132R <br />A RESOLUTION OF THE CITY OF SAN MARCOS <br />AUTHORIZING THE CAPITAL AREA RURAL <br />TRANSPORTATION SYSTEM ( "CARTS ") AS A DIRECT <br />RECIPIENT FOR THE SAN MARCOS URBANIZED AREA <br />FUNDING; AUTHORIZING THE CITY MANAGER TO ENTER <br />INTO AN INTERLOCAL AGREEMENT WITH CARTS WHICH <br />DELINEATES THE ROLES AND RESPONSIBILITIES OF THE <br />PARTIES, THE SERVICES CARTS WILL PROVIDE FOR THE <br />CITY, THE LOCAL SHARE REQUIRED FROM THE CITY TO <br />SUPPORT CARTS RELATED SERVICES, SERVICE <br />STANDARDS, FARE POLICY, THE APPORTIONMENT OF <br />FEDERAL AND STATE FUNDING BETWEEN CARTS AND THE <br />CITY, AND OTHER RELEVANT PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos ( "CITY ") has been designated by the Governor and the <br />Federal Transit Administration ( "FTA ") as the designated recipient for the San Marcos <br />Urbanized Area to receive the Urbanized Area Formula Program funding under 49 <br />U.S.C. §5307 ( "Section 5307); and <br />2. The Federal Transportation Administration apportions funding for transit <br />planning, operating assistance and capital investment under Section 5307 funding; and <br />3. The Capital Area Rural Transportation System ( "CARTS ") is a public agency and <br />a body corporate, independent and separate from the City; and <br />4. The CITY may authorize a public agency, to be a direct recipient for Section 5307 <br />funding; and <br />5. The CITY must inform FTA of the authorization in an annual "split letter" which <br />establishes the allocation of the Urbanized Area's Section 5307 funds; and <br />6. A public agency authorized as a direct recipient may submit independent grant <br />applications; and <br />7. The City may execute supplemental agreements, with public agencies that release <br />the CITY from any liability under the grant agreements; and <br />1 <br />
