6) Continue to collect, propagate, and maintain plants from January to December of 2013 in <br />order to provide plants for 2013 EAHCP projects as determined by the U.S. Fish and Wildlife <br />Service. ARC expects to propagate a minimum of 4800 plants during 2013 for restoration of <br />5350 m2 of the San Marcos River. In addition, ARC will continue propagation of plants, as <br />determined by the Service for restoration efforts in the following years and will develop more <br />effective and efficient propagation and establishment techniques for TWR and other native <br />aquatic plants found in the San Marcos River. <br />7) Perform its work in compliance with the following schedule: <br />a) January to December 2013 . - collection, propagation, and maintenance of TWR and other <br />native plants. <br />b) May to August 2013 - Final production of 4800 plants for restoration efforts on the San <br />Marcos River. <br />c) May to November 2013 — Monitoring the success /failure ratio of TWR and other native <br />aquatic plants planted for restoration efforts in the San Marcos River. Monitoring will <br />occur at 1, 3, 6, and 9 months, and will culminate with the submission of a final report to <br />the City no later than December 31, 2013. <br />d) In the event restoration activities preclude the delivery of ARC produced plants the U.S. <br />Fish and Wildlife Service will maintain plants for no longer than one month after 31 <br />December 2013 or one month following the termination of this Agreement. <br />B. City Agreements: <br />The City agrees to: <br />1) Designate Melam Howard, Watershed Protection Program Administrator as the City's <br />representative in all matters related to this Agreement. <br />2) Pick up the plants from ARC whenever the City is ready to replant in the San Marcos River. <br />Section 2. Compensation <br />The City agrees to pay ARC a fixed fee of $65,477.00 for ARC's performance of its Services <br />under this Agreement in accordance with the requirements of the United States Fish and Wildlife <br />Service upon receipt of an invoice from the ARC no sooner than February 1, 2013. The City will <br />provide an advance payment of the sum above for reimbursable work in the form of a check <br />made payable to the U.S. Fish and Wildlife Service. Neither party to this Agreement expects <br />that there will be a need for the provision of additional services.
