<br /> 7/11 <br /> Page 2 <br /> August 15, 1995 <br /> entitlement to compensation was found by CMS, and identify any responsibility of <br />,~ Southwestern Laboratories for design, testing or inspection deficiencies. The analysis will <br />i be based on a review of the contract documents, the City's project files, and the CMS <br />! analysis, and interviews with key personnel of the City, Hidell, Southwestern Laboratories, <br /> and if available, Kencon and Longley. It is anticipated that this analysis will be completed <br /> by October 16, 1995. <br /> 2. Project Control personnel will meet with key City personnel upon conclusion of the <br /> analysis to provi,de Project Control's opinions and recommendations regarding the Longley <br /> claim. If requested by the City, Project Control will prepare a written report of its analysis, <br /> opinions and recommendations. <br /> 3. Project Control personnel will be available to meet with representatives of Kencon <br /> and Longley to discuss the resolution of the Longley claim. <br /> ~ <br /> 4. Project Control personnel will be available for depositions, testimony, and settlement <br /> discussions involved in possible mediation or litigation of the Longley claim. <br /> 5. Project Control will identify the need, if any, for the City to engage a separate civil <br /> engineering or geotechnical firm, and if necessary, will recommend firms to perform these <br /> services. <br /> 6. Project Control will perform all of its services using the standards of care exercised <br />í by large, professional construction project management and claim analysis firms in Texas. <br /> 7. Project Control will maintain motor vehicle liability insurance in effect throughout the <br /> term of this agreement with at least the following limits: <br /> $250,000 Injury/death of anyone person <br /> $500,000 Injury/death of all persons/occurrence <br /> $100,000 Property damage <br /> 8. Project Control will invoice the City monthly for its hourly charges and expenses. <br /> City Obligations <br /> <br /> 1. The City will make available to Project Control all of its files related to the Longley <br /> claim, including the complete CMS report. <br />
