7/11 Page 2 August 15, 1995 entitlement to compensation was found by CMS, and identify any responsibility of ,~ Southwestern Laboratories for design, testing or inspection deficiencies. The analysis will i be based on a review of the contract documents, the City's project files, and the CMS ! analysis, and interviews with key personnel of the City, Hidell, Southwestern Laboratories, and if available, Kencon and Longley. It is anticipated that this analysis will be completed by October 16, 1995. 2. Project Control personnel will meet with key City personnel upon conclusion of the analysis to provi,de Project Control's opinions and recommendations regarding the Longley claim. If requested by the City, Project Control will prepare a written report of its analysis, opinions and recommendations. 3. Project Control personnel will be available to meet with representatives of Kencon and Longley to discuss the resolution of the Longley claim. ~ 4. Project Control personnel will be available for depositions, testimony, and settlement discussions involved in possible mediation or litigation of the Longley claim. 5. Project Control will identify the need, if any, for the City to engage a separate civil engineering or geotechnical firm, and if necessary, will recommend firms to perform these services. 6. Project Control will perform all of its services using the standards of care exercised í by large, professional construction project management and claim analysis firms in Texas. 7. Project Control will maintain motor vehicle liability insurance in effect throughout the term of this agreement with at least the following limits: $250,000 Injury/death of anyone person $500,000 Injury/death of all persons/occurrence $100,000 Property damage 8. Project Control will invoice the City monthly for its hourly charges and expenses. City Obligations 1. The City will make available to Project Control all of its files related to the Longley claim, including the complete CMS report.
