(16) MOTION: Upon a motion made by Council Member Scott and a second by Council <br />Member Prather, MOTION TO AMEND: Upon a motion made by Council Member Scott and <br />a second by Council Member Prather, the City Council voted seven (7) for and none (0) opposed, <br />to amend the amount stated in caption to reflect the annual amount of $99,803.10, as opposed to <br />the 5 year contract amount of $537,404.05. The motion carried. MAIN MOTION: the City <br />Council voted (7) for and none (0) opposed, to approve, Resolution 2012 -151R, as amended. The <br />motion carried. <br />Public Hearing <br />18.7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments for <br />or against Ordinance 2012 -50 amending the San Marcos City Code, Subpart C, the <br />"San Marcos SmartCode," by modifying Lighting Standards and Sign Standards, <br />adding Downtown Architectural Standards, and adding an Appendix with Downtown <br />Design Guidelines; including procedural provisions; and providing an effective date; <br />and consider Ordinance 2012 -50, on the first of two readings. <br />Matthew Lewis, Director of Development Services provided a staff presentation. <br />Mayor Daniel Guerrero opened the Public Hearing at 8:38 p.m., there being no comments; the <br />public hearing was closed at 8:38 p.m. <br />MOTION: Upon a motion made by Council Member Thomaides, and a second by Council <br />MemberPrather the City Council voted seven (7) for and none (0) opposed, to approve <br />Ordinance 2012 -50, as previously captioned. The motion carried. <br />Non Consent Agenda <br />19.Consider approval of Ordinance 2012 -51, on the first of two readings, approving the <br />abandonment of a 300 foot by 50 foot, more or less, section of Dale Drive between Allen <br />Street and Furman Avenue; authorizing the City Manager to execute a deed to the <br />abutting lot owner upon payment of the fair market value of said abandoned street <br />section in the amount of $14,900.00; and declaring an effective date. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Thomason, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2012 -51, on the first of two readings, as previously captioned. The motion carried. <br />20.Consider approval of Ordinance 2012 -52, on the first of two readings, approving the <br />abandonment of a 109 foot by 22 foot, more or less, alley section within the 100 block of <br />East Martin Luther King Drive, being the former site of the Hays County Justice <br />Center; authorizing the City Manager to execute a deed to the abutting owner upon <br />payment of the fair market value of said abandoned alley section in the amount of <br />$8,453.00; and declaring an effective date. <br />
