19.7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments for <br />or against Resolution 2012 -158R, approving the issuance of a Certificate of Public <br />Convenience and Necessity to Emmanuel John, d /b /a Americo Express Transportation, <br />for the provision of taxicab services in San Marcos; and declaring an effective date, and <br />consider approval of Resolution 2012 -158R. <br />Mayor Daniel Guerrero opened the Public Hearing at 7:48 p.m. <br />William Kennon, CEO of Aloha Taxi, stated that he did not feel that another taxi service was <br />necessary in San Marcos, and that the two current taxi services are able to meet the current <br />demand. <br />Emmanuel John, 701 Beaver St, Austin, TX 78753, addressed the Council regarding his business <br />plan and that his business receives phone calls often for service in San Marcos to Austin or San <br />Antonio. He wants to help the people of San Marcos. <br />There being no further comments; the public hearing was closed at 7:51 p.m. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Prather, the City Council voted six (6) for, one (1) absent, Council Member Thomaides, and <br />none (0) opposed, to approve Resolution 2012 -158, as previously captioned. The motion carried. <br />20.7:OOPM Receive a Staff Presentation and hold a Public Hearing to receive comments for <br />or against a development agreement between Lazy Oaks Ranch, LP and the City of San <br />Marcos. <br />Kristy Stark, Assistant Director of Development Services, provided a brief presentation. Thomas <br />Rhoades, ETR Development Consulting, also provided a brief presentation. <br />Mayor Daniel Guerrero opened the Public Hearing at 9:09 p.m. <br />Jon Engel, 407 Pioneer Trail, addressed the Council regarding the Lazy Oaks Ranch <br />development agreement and mentioned that the developer failed to mention their work with the <br />adjacent neighbors or the County. He addressed that Hays County Tax Bonds were to be used to <br />protect open space and natural areas. RFPs were received for these funds and this land owner <br />presented this property to the board and scored in the top three. It did not get selected to be <br />purchased by the County so now he is trying to sell it this way. <br />Max Schleder, 616 Pioneer Trail, addressed the Council regarding the RFP that was submitted <br />for consideration and that the property was perfect for the Endangered Habitat protection. 57% <br />of this property is high value. They are preserving 300 acres of 800 acres of habitat that needs to <br />be preserved. The developers decided not to participate in the public meeting or the staff <br />meeting. Stated that he felt they have ignored the neighbors and before the comp plan is <br />adopted. <br />
