It <br /> V. <br /> This Agreement is expressly subject and subordinate to the <br /> present and future right of Licensor, its successors, assigns, <br /> lessees, franchisees, grantees and licensees, to construct, <br /> install, establ ish, maintain, use, operate and renew any pub 1 i c <br /> utilities facilities, franchised pub 1 i c utilities, roadways or <br /> streets on, beneath or above the surface of the Licensed Area. <br /> Licensor does, however, agree to give Licensee at leasty ninety <br /> (90) days' written notice of such action and shall cooperate with <br /> Licensee to effect the relocation of Licensee's if1stallations and <br /> improvements in the event of such widening, altering or <br /> improvment of such street areas and, furt.her, to cooperate wi th <br /> Licensee wherever possible, to effect such widening, altering or <br /> improving of such street areas so that Licensee's operations and <br /> improvements on the Licensed Area wi 1 1 not be materially affected <br /> thereby. <br /> Notwithstanding, any provision in this Agreement to the <br /> contrary, Licensor retains the right, after ninety (90) days' <br /> written notice to Licensee, to enter upon the Licensed Area and <br /> at Licensee's expense, to remove any structure or improvements or <br /> alterations thereon whenever the Licensor's governing body <br /> deems such removal to be necessary for exercising Licensor's <br /> 4. <br />
