All minor plats that are not eligible for administrative approval shall <br /> be forwarded to the commission with staff comn;¡ents. The <br /> commission shall have thirty (30) days from the time the plat is filed <br /> ; to approve or disapprove the plat. On request of a subdivider, the <br /> commission shall furnish a written statement of the reasons for the <br /> action taken on the subdivider's plat. <br /> e. The commission may determine that a plat submitted as a minor plat <br /> does not meet the criteria for consideration as a minor plat. Upon <br /> such a determination, the plat shall be disapproved, and shall then <br /> be processed under the requirements for a preliminary and final plat <br /> in Article V, Sections D and E of this ordinance. <br /> f. If the plat is approved and all the requirements of this ordinance <br /> have been met, the commission shall cause the plat to be filed with <br /> county clerk of the county in which the property on the' plat is <br /> located. No minor plat shall be filed for record without the written <br /> consent of the subdivider. If the subdivider fails to give written <br /> consent within thirty (30) days of the date of final approval of the <br /> plat, the commission may, at any time thereafter, cancel the <br /> approval. <br /> g, Nothing in this section shall prohibit a subdivider from presenting the <br /> commission with a proposal, sketch or outline of what the subdivider <br /> proposes to do with a tract of property prior to the actual platting of <br /> the property. <br /> SECTION 3, That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br /> invalid portion had not been adopted. <br /> SECTION 4. That all ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict herewith are hereby repealed. <br /> SECTION 5, That any person violating any provision of this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br /> provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> SECTION 6.
