All minor plats that are not eligible for administrative approval shall be forwarded to the commission with staff comn;¡ents. The commission shall have thirty (30) days from the time the plat is filed ; to approve or disapprove the plat. On request of a subdivider, the commission shall furnish a written statement of the reasons for the action taken on the subdivider's plat. e. The commission may determine that a plat submitted as a minor plat does not meet the criteria for consideration as a minor plat. Upon such a determination, the plat shall be disapproved, and shall then be processed under the requirements for a preliminary and final plat in Article V, Sections D and E of this ordinance. f. If the plat is approved and all the requirements of this ordinance have been met, the commission shall cause the plat to be filed with county clerk of the county in which the property on the' plat is located. No minor plat shall be filed for record without the written consent of the subdivider. If the subdivider fails to give written consent within thirty (30) days of the date of final approval of the plat, the commission may, at any time thereafter, cancel the approval. g, Nothing in this section shall prohibit a subdivider from presenting the commission with a proposal, sketch or outline of what the subdivider proposes to do with a tract of property prior to the actual platting of the property. SECTION 3, That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 4. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 5, That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1-5 of the San Marcos Code of Ordinances. SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas. , -, PASSED AND APPROVED on first reading August 28, 1995. !
