<br /> 13~ß <br /> -3- <br /> With respect to the requirement of State law that a contract for human services to the <br /> indigent entered into between a City and a social services organization may not provide <br /> more than 50% of the annual budget of the organization to be derived from City funds, <br /> .- PHS declares that at the time of the execution of this agreement, funds to be provided <br /> herein do not exceed 50% of the annual budget of PHS. In the event that such funds do <br /> exceed 50% of the annual budget of PHS at any time during which this contract is in effect, <br /> PHS agrees to ~otify City immediately so that appropriate monetary adjustments to this <br /> contract can be made to assure compliance with State Law. <br /> SECTION 10. Breach of Contract: <br /> A. If the City Manager of the City determines that the activities as described in <br /> . <br /> the Human Services funding application attached hereto are not being carried out as <br /> approved by the City or that PHS is in breach of any of the terms of this agreement, the <br /> City Manager shall notify PHS in writing of the deficiency. PHS shall have ten (10) working <br /> days from the date of the notice to correct or satisfy the deficiency. <br /> B. If the deficiency is not appropriately corrected or satisfied in the opinion of the <br /> City Manager within the prescribed time, notice may be given to PHS that its funding will <br /> be terminated. <br /> C. A decision of the City Manager to terminate funding may be appealed to the <br /> City's Human Services Advisory Board within ten days of the date of the notice to terminate <br /> funding. During the appeal process, funding to PHS shall continue. <br /> D. The Human Services Advisory Board shall conduct a hearing on the matter <br /> within ten (10) days of receipt of an appeal and render a decision on the appeal as soon <br />
