<br /> - - <br /> r -- -- 50 <br /> - <br /> AMENDMENT NO.2 TO <br /> TEXAS CAPITAL FUND <br /> CONTRACT NO. 703162 <br /> TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS <br /> AND THE <br /> CITY OF SAN MARCOS <br /> STATE OF TEXAS <br /> COUNTY OF TRAVIS <br /> -- <br /> Section 1. <br /> The Texas Department of Housing and Community Affairs, an agency of the State of Texas, <br /> hereinafter referred to as "Department", and the City of San Marcos, hereby contract and agree to <br /> amend their original contract, as initially executed by the Executive Director of the Department <br /> effective January 22, '1994, through January 21, 1997, for the performance of economic development <br /> activities. <br /> Section 2. <br /> The parties hereto agree to amend the contract identified in Section 1 above by deleting in its entirety <br /> Section 1, Parties to Contract, and replacing it with the following: { <br /> Section 2. PARTIES TO THE CONTRACT <br /> This contract and agreement is made and entered into by and between the <br /> Texas Department of Housing and Community Affairs, an agency of the State of <br /> Texas, hereinafter referred to as "Department", and the City of San Marcos, a <br /> political subdivision of the State of Texas, hereinafter referred to as "Contractor". <br /> Department has contracted with the Texas Department of Commerce, <br /> hereinafter referred to as "Commerce", to provide certain services relating to this <br /> and other Capital Fund agreements. In recognition of the contract between <br /> Department and Commerce, Department'and Contractor agree that Commerce <br /> shall provide the following services relating to this agreement on behalf of <br /> Department: 1.) provide technical assistance to Contractor; 2.) administer this <br /> agreement on behalf of Department; and 3.) provide audit resolution, monitoring, <br /> contract enforcement and collection services under this agreement on behalf of <br /> Department. The parties further agree that Contractor shall continue to make <br /> any payments due under this agreement to Department and that Department <br /> shall continue to provide accounting services associated with the agreement. <br /> The parties hereto have severally and collectively agreed and by the execution <br /> hereof are bound to the mutual obligations and to the performance and <br /> accomplishment of the tasks described herein. <br /> Section 3. <br /> The parties hereto agree that this amendment shall become effective on July 1, 1995. <br /> Page 1 of 2 <br />
