<br /> -9- <br /> PROPOSITION NO. 6 <br /> FOR/AGAINST The amendment of section 4.04 of the City <br /> Charter to clarify the appointment, <br /> duties and removal of the city attorney <br /> and assistants. <br /> PROPOSITION NO. 7 <br /> FOR/AGAINST The amendment of section .5.05 of the city <br /> Charter to allow for exceptions to the <br /> requirement that runoff elections be held <br /> three weeks after the preceding election, <br /> when allowed by state law. <br /> PROPOSITION NO. 8 <br /> FOR/AGAINST The amendment of section 7,01 and <br /> sections 7.03 through 7.08 of the city <br /> Charter to combine the Planning <br /> Commission and the Zoning commission into <br /> a single Planning and zoning commission. <br /> PROPOSITION NO. 9 <br /> FOR/AGAINST The amendment of section 12.03 of the <br /> City Charter to eliminate duplication of <br /> state law pertaining to nepotism, and to <br /> extend state nepotism restrictions to the <br /> city council, city manager, city <br /> secretary, city attorney, and presiding <br /> municipal court judge. <br /> PROPOSITION NO. 10 <br /> FOR/AGAINST To rededicate for the construction and <br /> operation of a city activity center for <br /> park, recreational and convention <br /> purposes a tract of land of up to 5.5 <br /> acres In size on Hopkins Street between <br /> the new city library and the railroad <br /> right-of-way. <br /> SECTION 2. That this ordinance is cumulative of the Ordinance <br /> described in SECTION 1 of this Ordinance, and all provisions of <br /> that ordinance remain in full force and effect. <br /> SECTION 3. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 4. That the importance of this Ordinance creates an <br /> emergency and an imperative public necessity so that the provisions <br /> of the Charter requiring that ordinances shall be presented at <br /> three separate meetings and that no ordinance shall become <br /> effective until the expiration of ten (10) days following the date <br /> of its final passage be suspended, and these provisions are hereby <br /> suspended, and this Ordinance shall take effect and be in full <br /> force and effect from and after its adoption and after its <br /> publication in a newspaper of general circulation within the City <br /> as provided by the City Charter of the City of San Marcos. <br /> PASSED, APPROVED AND ADOPTED this 22nd day of February , 1994. <br />
