-9- PROPOSITION NO. 6 FOR/AGAINST The amendment of section 4.04 of the City Charter to clarify the appointment, duties and removal of the city attorney and assistants. PROPOSITION NO. 7 FOR/AGAINST The amendment of section .5.05 of the city Charter to allow for exceptions to the requirement that runoff elections be held three weeks after the preceding election, when allowed by state law. PROPOSITION NO. 8 FOR/AGAINST The amendment of section 7,01 and sections 7.03 through 7.08 of the city Charter to combine the Planning Commission and the Zoning commission into a single Planning and zoning commission. PROPOSITION NO. 9 FOR/AGAINST The amendment of section 12.03 of the City Charter to eliminate duplication of state law pertaining to nepotism, and to extend state nepotism restrictions to the city council, city manager, city secretary, city attorney, and presiding municipal court judge. PROPOSITION NO. 10 FOR/AGAINST To rededicate for the construction and operation of a city activity center for park, recreational and convention purposes a tract of land of up to 5.5 acres In size on Hopkins Street between the new city library and the railroad right-of-way. SECTION 2. That this ordinance is cumulative of the Ordinance described in SECTION 1 of this Ordinance, and all provisions of that ordinance remain in full force and effect. SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 4. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Marcos.
