amended by Sections 3.02 to 3.06 below. All other uses within this PDD shall be <br />prohibited. <br />Part 3. Land Use Restrictions <br />3.01. Generally. As stated above, the base zoning for the Project Site will be the MU <br />District, however the provisions of Section 4.3.1.2 of the Land Development Code <br />( "LDC ") that would otherwise allow fraternity houses, sorority houses, boarding houses, <br />dormitories, and multifamily apartments in a Mixed Use zoning District with a conditional <br />use permit shall be inapplicable to this site. No portion of the site shall be used for <br />fraternity houses, sorority houses, boarding houses, dormitories, or multifamily <br />apartments land uses without approval of a petition for a zoning map amendment by <br />ordinance of the San Marcos City Council. Except as otherwise amended, modified or <br />supplemented in these Development Standards, all regulations applicable to that base <br />zoning district will apply to the Project Site. The Project Site will be restricted to the uses <br />identified herein. <br />3.02 Permitted Residential Uses. The following chart illustrates those residential uses <br />that are permitted by right within the Project Site: <br />Development Areas 1 and 2 <br />Single Family Detached House* <br />Development Area 3 <br />None <br />" There will be no prohibition on the use of a Church or religious assembly hall on the property to the <br />extent required by law. <br />3.03 Permitted Accessory Uses. The following chart illustrates those accessory uses <br />that are permitted by right within the Project Site: <br />Development Areas 1 and 2 <br />1 <br />Caretaker's /Guard's Residence <br />Accessory Build in /Structure <br />Development Area 3 <br />Accessory Building/Structure <br />3.04 Occupancy Restrictions. The following occupancy restrictions shall apply to <br />residential uses on this property: <br />a. All residential uses identified in Section 3.02 above shall be restricted to <br />occupancy by a family in accordance with the occupancy restrictions identified in <br />Section 4.3.4.5 of the LDC. <br />b. The provisions of this section shall be enforced through the residential lease <br />agreements and occupancy shall be based upon the lessee(s) indicated on the <br />residential lease. <br />Restated Planned Development District 2012 3 <br />
