<br />IZl.{c- <br /> <br /> <br />-4- <br /> <br />(e) A bill shall be considered delinquent if the full <br />amount of the bill is not paid by the due date. A bill <br />is considered paid if the payment is either received by <br />the City or postmarked by the postal service no later <br />than the due date. <br /> <br />(f) A penalty service charge of ten percent (10%) shall be <br />assessed against the portion of the delinquent bill <br />that is not paid before the penalty date. <br /> <br />(g) Any or all city utility services may be disconnected or <br />discontinued for nonpayment of all or any portion of a <br />bill for city utility services if a termination notice <br />is given by the city and at least twenty-five (25) days <br />have elapsed since the date of issuance of the bill. <br /> <br />SECTION 5. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 6. That all ordinances and resolutions in conflict <br />herewith, including ordinances 1991-53, 1992-49, 1993-30 and 1993- <br />28, are hereby repealed. <br /> <br />SECTION 7. That any person who violates any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty prescribed in section 1- <br />5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 8.
