A sample shall consist of a <br />composite of a minimum of four samples collected at <br />approximately equal intervals during the operating <br />period (the posted opening time until one-hour <br />after the posted closing time). A duplicate sample <br />will be provided to the user, if requested, for <br />delivery to a laboratory of the user's choice for <br />analysis. The analytical results from the <br />laboratory selected by the user, including a copy <br />of the chain-of-custody form, must be sent by the <br />laboratory directly to the Director of Public Works <br />within 10 days of date of sampling. The submittal <br />from the user's laboratory must include a copy of <br />the laboratory Quality Assurance Plan and a copy <br />of the most recent Quality Assurance Inspection <br />Report of the Texas Natural Resources Conservation <br />commission for the laboratory operations. <br /> <br />3. Provided that the user's laboratory analytical <br />result for COD is within ten percent of the city's <br />laboratory result, the lower reading of the two <br />sample resul ts will be used i for surcharge <br />determination. If the difference in analytical <br />results between the two samples exceeds ten <br />percent, a portion of the original sample will be <br />submitted by the city to a third laboratory and the <br />result obtained will be used for surcharge <br />calculation. <br /> <br />4. A request for re-sampling shall be submitted by a <br />user in writing to the Director of Public Works. <br />Only one re-sampling will be performed during the <br />calendar year. The user shall be charged a $200.00 <br />fee for re-sampling. Re-sampling will only be <br />performed if the user has modified or installed <br />new, permanent pretreatment facilities; or if the <br />user has made a significant change in process <br />operations as described in the request for <br />resampling. <br /> <br />In addition to any surcharge applicable to a user under the formula <br />described in (b) above, a minimum testing fee for surcharge program <br />participants is set at $24.00 per sampling port. <br /> <br />SECTION 4. That, pursuant to Section 30-99 of the San Marcos <br />Code of Ordinances, the following provisions shall apply to billing <br />procedures for waste surcharges and sampling fees. <br /> <br />(a) Calculations of sewer surcharges on users served by <br />metered water shall be based on water usage, while <br />surcharge 'calculations for users not served by metered <br />water shall be based upon wastewater volume discharged <br />to the sewer system. <br /> <br />(b) New users shall not be subject to surcharge fees until <br />both the issuance of a certificate of occupancy and a <br />minimum period of six months water usage has occurred. <br /> <br />(c) That person paying the water bill, or the wastewater <br />bill for entities not served by the municipal water <br />system, shall be responsible for payment of sewer <br />surcharges. <br /> <br />(d) The due date for all bills shall be the fifteenth day <br />following the date of issuance. The penalty date shall <br />be the twentieth day following the date of issuance. <br />
