The indemnity <br /> <br />required hereunder shall not be limited by reason of the specification <br /> <br /> <br />of any particular insurance coverage in this Agreement. <br /> <br /> <br />17. Insurance: <br /> <br />a. The Lessee shall, at its own expense, purchase and maintain <br /> <br /> <br />insurance to protect it frorn claims as set forth below which may <br /> <br />arise under this Agreement: <br /> <br /> <br />(1) Worker compensation insurance - statutory limits. <br /> <br /> <br />(2) Cornprehensive general liability insurance - $250,000/ <br /> <br /> <br />$500,000/$100,000 or $500,000 combined single limit. <br /> <br /> <br />b. The insurance coverage shall be written so that the Lessor will be <br /> <br />notified in writing, in the event of cancell~tion, restrictive <br /> <br /> <br />amendment or non-renewal at least thirty (30) days prior to such <br /> <br /> <br />action. Certificates of Insurance shall be filed with the Lessor <br /> <br /> <br />prior to Lessee's entry upon the leased premises and annually <br /> <br /> <br />thereafter, and are subject to Lessor's prior approval. <br /> <br />c. ALL INSURANCE COVERAGE REQUIRED HEREIN SHALL BE WRITTEN WITH THE <br /> <br /> <br />CITY OF SAN MARCOS, TEXAS, AS CO-INSURED. The stated limits of <br /> <br /> <br />insurance required herein are MINIMUM ONLY, and it shall be the <br /> <br /> <br />Lessee's responsibility to determine what limits are adequate. <br /> <br /> <br />These minimurn limits rnay be basic policy limits to any combination <br /> <br /> <br />of basic limits and umbrella limits. In any event, the Lessee is <br /> <br /> <br />fully responsible for all losses arising out of, resulting from or <br /> <br />-7- <br />
