40. <br />Regular Meeting August 25, 2003 Page 6 <br /> <br />Mr. Mihalkanin stated he also supports the neighborhood. He inquired <br />whether the Staff has contacted the University regarding the extended <br />hours. He stated he wants to make the Graduate Students aware since most <br />work during the day and they are accustomed to parking there. Since they <br />work during the day, they will not get the word before receiving a ticket. <br />Mr. Taylor asked whether the violators could receive a warning ticket <br />before being towed. Mr. 0'Leary stated the problem is currently handled <br />by towing the vehicles who are parked in violation. Mayor Habingreither <br />stated there is a problem in the neighborhood and asked for good signage <br />before enforcing this change. The Council then voted unanimously for <br />approval of the Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration approval of minutes of <br />the Special Meeting held August 11, 2003, approval of minutes of the <br />Regular Meeting held August 11, 2003, approval of three Ordinances on <br />second reading, adoption of one Ordinance on third and final reading, <br />adoption of twelve Resolutions (Item #18 with amendments), on consensus. <br />The Council removed Items ~17 and ~27, adoption of Resolutions, to be <br />considered separately. Mr. Montoya moved for approval of the minutes of <br />the Special Meeting held August 11, 2003,approval of minutes of the <br />Regular Meeting held August 11, 2003, approval of three Ordinances on <br />second reading, adoption of Ordinance on third and final reading, and <br />adoption of the remaining ten Resolutions (Item ~18 with amendments), by <br />consensus and Ms. Narvaiz seconded the motion, which passed unanimously. <br />(Mr. Mihalkanin abstained on Item 11, approval of minutes held August 11, <br />2003 and Item ~13, approval of an Ordinance on second reading). The <br />captions of the Ordinances and Resolutions read as follows: <br /> <br />Approval of Ordinances on second reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTIONS 14.006, 14.008 AND 86.309 OF THE CITY CODE TO <br />EXEMPT CONSTRUCTION PROJECTS FROM CONSTRUCTION PERMIT FEES AND IMPACT <br />FEES IF THEY ARE FUNDED IN WHOLE WITH COMMUNITY DEVELOPMENT BLOCK <br />GRANT FUNDS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />(Mr. Mihalkanin abstaining to the preceding Ordinance.) <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 26.26 ACRES, MORE OR <br />LESS, LOCATED OFF OF AND SOUTHEAST OF THE 2200 BLOCK OF IH-35 NORTH <br />(HOLT TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR <br />PUBLICATION; AND DECLARING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING WATER AND WASTEWATER RATES ESTABLISHED UNDER SECTIONS <br />86.231 AND 86.262 OF THE SAN MARCOS CITY CODE; AMENDING SECTION <br />86.133 OF THE CITY CODE TO ADD A SUBSECTION (1) SETTING WASTEWATER <br />SURCHARGE RATES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br /> <br />
