<br />142 <br /> <br /> <br />AMENDMENT NO. 3 <br />WASTEWATER MASTER PLAN <br />ENGINEERING SERVICES AGREEMENT <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The City of San Marcos ("CITY") and Black & Veatch <br />("ENGINEER") do hereby agree to amend the Wastewater Master <br />Plan Engineering Services Agreement, dated October 12, 1993. <br /> <br />1. The parties agree to amend the Agreement to <br />authorize additional services under Paragraph 3.2 of the <br />Agreement to allow for the reinstallation of 12 flow monitors <br />and 3 rainfall gauges for an additional 8 week period in <br />order to gather sufficient data to evaluate the impact of the <br />infiltration/inflow on the San Marcos wastewater system. <br /> <br />2. The total compensation to be paid to the Engineer <br />for its performance of these additional services shall not <br />exceed $64,000.00 without the written consent of the City. <br />It is understood by both parties to the Agreement that if <br />adequate rainfall events occur before the end of the 8 week <br />period, the monitors and gauges will be removed and the total <br />cost to the City will be reduced by $890.00 per day for each <br />day that the monitoring system is ~ot in place. <br /> <br />3 .
