<br />(~p <br /> <br />involvement in the construction of the improvements described in <br /> <br />Paragraph 10.01 above, and shall have no responsibility for the <br /> <br />payment of any costs related thereto. <br /> <br />The City, however, shall <br /> <br />have the following rights and obligations in regard to said <br /> <br />improvements: <br /> <br />(a) The right to make inspections of the construction <br />in accordance with the City's policies and <br />procedures related to construction projects. <br /> <br />(b) The obligation to accept the improvements for <br />operation, maintenance and ownership after the work <br />has been completed in accordance with the Project <br />Documents. <br /> <br />10.04 The SMCISD hereby agrees to be solely responsible <br /> <br />for all costs and expenses incurred in regard to the design and <br /> <br />construction of the improvements listed in Paragraph 10.01 above. <br /> <br />The City agrees that SMCISD shall be entitled to use the-funds <br />escrowed with the City to pay for the costs incurred by the SMCISD <br /> <br />for the design and construction of the improvements described in <br /> <br />Paragraph 10.01 above. <br /> <br />ARTICLE 11 <br /> <br />MISCELLANEOUS <br /> <br />11.01 <br /> <br />Section Headinqs: <br /> <br />The headings or title of the <br /> <br />several articles and sections of this Agreement are solely for <br /> <br />convenience of reference and shall not affect the meaning, <br /> <br />construction or effect of the provisions hereof. <br /> <br />11.02 <br /> <br />Interpretation: The singular form of any word used <br /> <br />herein shall include the plural, and vice versa unless the context <br /> <br />requires otherwise.
