<br />146 <br /> <br />TRI-PARTY AGREEMENT <br />FOR <br />UTILITY AND ROAD IMPROVEMENTS <br /> <br />....... ~ <br /> <br />.. <br /> <br />This Tri-Party Agreement For Utility Improvem~nts <br /> <br />(the <br /> <br />"Agreement") between the CITY OF SAN MARCOS (the "City"), the SAN <br /> <br />MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT (the Il SMCISD") and <br /> <br />TETCO, INC. ("TETCO") is made and entered into as of the <br /> <br />/ / t::i <br />L day <br /> <br />of <br /> <br />WI Ai <br /> <br />1994, for the purposes to delineate the duties, <br /> <br />obligations, <br /> <br />cooperation and participation in the mutually <br /> <br />beneficial construction and maintenance of certain utility <br /> <br />improvements, as herein further detailed and set forth. <br /> <br />WIT N E SSE T H <br /> <br />WHEREAS, the City, SMCISD and TETCO mutually desire to have <br /> <br />utility improvements constructed, integrated and maintained into <br /> <br />the City's water and wastewater collector system; and <br /> <br />WHEREAS, TETCO, the City and the SMCISD receive mutual benefit <br /> <br />from such improvements, and the parties agree to contribute their <br /> <br />mutually agreed share for the construction of said improvements; <br /> <br />NOW, THEREFORE, for and in consideration of the covenants, <br /> <br />agreements, representations and promises hereinafter expressed and <br /> <br />other good and valuable consideration, the sufficiency of which is <br /> <br />hereby acknowledged and confessed, the parties do hereby covenant <br /> <br />and agree as follows: <br /> <br />Tri-Party Agreement for <br />Utility and Road Improvements <br />
