<br />14(,(, <br /> <br />(8) Notifying the Project Manager in advance of <br />pending progress meetings so as to allow the <br />Project Manager sufficient time to notify each <br />of the parties hereto, or their <br />representatives who may be involved with the <br />observation of the construction progress on <br />behalf of a party, so that said <br />representatives can attend said meetings if <br />they so desire. <br /> <br />(9) Reporting to the Project Manager whether or <br />not the Contractor, in the opinion of the <br />Engineer, is performing the work in accordance <br />with the Project Documents; and in the event <br />the Contractor is not, then recommending to <br />the Project Manager alternate plans of <br />actions which should be considered and perhaps <br />taken in order to obtain compliance. <br /> <br />(10) Preparing and submitting to the City <br />reproducible lIas-builtll construction plans <br />based upon the Contractor's record documents <br />for the Project. <br /> <br />(11) Performing such other acts as are normally and <br />reasonably performed by the Design <br />Professional and Project Engineer on a project <br />of this nature in regard to the design and <br />construction of the Project and in regard to <br />construction administration. <br /> <br />(b) Soliciting and putting out for public, competitive <br />bidding, the Project Documents as required by and <br />in accordance with prevailing statutes of the State <br />of Texas and the Texas Education Code. <br /> <br />(c) Entering into a contract (lIConstruction Contractll) <br />in the capacity of, the Owner with the lowest <br />responsible and responsive bidder for the <br />construction of the work described in the Project <br />Documents in accordance with the Standard Form of <br />Agreement Between Owner and Contractor on the Basis <br />of a Stipulated Sum, EJCDC Document No. 1910-8-A-1 <br />(1990 Edition), and any amendments thereto as <br />deemed appropriate by the Project Manager, and the <br />Standard General Conditions of the Construction <br />Contract, EJCDC Document No. 1910-8 (1990 <br />Edition/Reprinted by /91) . <br /> <br />(d) Performing any and all other acts reasonable or <br />appropriate in order to facilitate the construction <br />of the work in accordance with the Project <br />Documents. <br /> <br />Tri-Party Agreement for <br />Utility and Road Improvements <br /> <br />4 <br />
