/'1(pi:) 2.03 The parties hereto acknowledge and agree that the Project Manager's obligations hereunder shall not imply that the Project Manager is responsible in any manner for the means, methods and sequencing of the construction including, but not limited to, safety precautions, all of which matters shall be the sole responsibility of the Contractor engaged pursuant to this Agreement. ARTICLE 3 OBLIGATIONS AND AGREEMENTS OF THE CITY OF SAN MARCOS 3.01 Because the proj ect is being constructed within the limits of the City and/or within its extraterritorial jurisdiction, the parties hereto hereby acknowledge that the City will have certain obligations related to the construction of the Project which will be unique to the City. The City hereby agrees to provide the services as set forth herein as part of its obligations and agreements under the terms and provisions of this Agreement. 3.02 The City hereby acknowledges and agrees that it either has performed or will perform the following services in regard to the construction of the Project: (a) The City has reviewed the plans and specifications for the construction of the work covered by the proj ect Documents prepared by Byrn & Associates, Inc. The City acknowledges that said plans and specifications have been finally approved by the City and that said plans and specifications meet all appropriate and applicable standards and codes established by the City. The City shall have the authority to review and approve all change orders affecting the water and wastewater system portion of the Project. The City further agrees that if there is any further review of the Project Documents or of any amendments thereto resulting from any change orders or otherwise, that the City Tri-Party Agreement for Utility and Road Improvements 5
