<br />jLfbF <br /> <br />(i) The City agrees that it will accept for operation <br />and maintenance that portion of the work included <br />in the proj ect Documents which consists of the <br />construction of Stagecoach Road and the relocation <br />of the 1611 water main and any work incidental <br />thereto in advance of the completion of the <br />remainder of the work covered by the Project <br />Documents, subject to the issuance by the City of a <br />certificate of acceptance for said portion of the <br />work. <br /> <br />ARTICLE 4 <br /> <br />OBLIGATIONS AND AGREEMENTS OF TETCO <br /> <br />4.01. The parties hereto hereby acknowledge and agree that <br /> <br />TETCO has certain obligations which are unique to TETCO under the <br /> <br />terms of this Agreement. TETCO hereby agrees that it will perform <br /> <br />said obligations in addition to any and all other obligations of <br /> <br />TETCO set forth herein as part of its obligations and agreements <br /> <br />under the terms and provisions of this Agreement. <br /> <br />4.02 TETCO shall dedicate certain easements, as described in <br /> <br />the plats which are attached hereto as Exhibits IIDII and IIEII, which <br /> <br />are necessary for the construction of the proj ect and for the <br /> <br />approval of said plats. <br /> <br />4.03 TETCO agrees to execute and sign the plats attached <br /> <br />hereto as Exhibits liD II and IIEII so that said plats can be finally <br /> <br />approved by the City. <br /> <br />4.04 TETCO warrants that it has the full power and authority <br /> <br />to enter into this Agreement and fulfill its obligations hereunder, <br /> <br />and that it has funds readily available to meet its obligations <br /> <br />under this Agreement. <br /> <br />Tri-Party Agreement for <br />Utility and Road Improvements <br /> <br />7 <br />
