<br /> # <br /> 45 <br /> AUcrIONEER SERVICES AGREEMENT <br /> This AGREEMENT is made this 26th day of April , 1994, between <br />the CITY OF SAN MARCOS, TEXAS, hereinafter referred to as "CITY", 630 <br />East Hopkins, San Marcos, Texas 78666, and LONE STAR AUCTIONEERS, INC., <br />hereinafter referred to as "AUCTIONEER", 1050 Forest Park Blvd., Suite, <br />105, Forth Worth, Texas 76110 for auctions of City personal property <br />and abandoned and unclaimed property held by the City. <br /> WITNESSETH: CITY and AUCTIONEER do agree as follows: <br /> ARTICLE 1 <br />-- AUcrIONEER'S SERVICES AND RESPONSIBILITIES <br />1.1 The AUCTIONEER will perform all services in connection with this <br />Agreement using that degree of care and skill ordinarily exercised by <br />auctioneers which possess special expertise in conducting auctions for <br />cities. <br />1.2 The AUCTIONEER certifies that it is in good standing with all <br />current regulatory and licensing agencies of the State and that all <br />sales tax permits, registrations, business licenses and any other <br />permits required will remain current. AUCTIONEER further certifies <br />that all of its employees to be involved in the conduct of each auction <br />will be bonded and that its auctioneers will be licensed under State <br />law. <br />1.3 The AUCTIONEER will provide the City with a mi:qimum of ten (10) <br />regular members of its auction staff to.conduct each auction and all <br />other related functions in an efficient manner. Included in the ten <br />staff members will be three licensed auctioneers, a computer operator, <br />bid spotters, registrars, cashiers, a bilingual staff member, and <br />security personnel. The AUCTIONEER will designate a member of its <br />staff as the Auction Coordinator in writing prior to. each auction to <br />assist the CITY's representative and to coordinate the AUCTIONEER's <br />activities. <br />1.4 Not later than the day prior to each auction, the AUCTIONEER will <br />provide personnel to affix lot tags and numbers to the items for sale, <br />and to record those numbers on inventory logs. If the AUCTIONEER is <br />conducting a j oint auction for the CITY and Hays County, then during <br />the lotting and inventory process AUCTIONEER's personnel will cross <br />reference the City's and Hays County's inventory numbers with the <br />appropriate cost center/fund information so that the City and County <br />reports will be separately printed and reconciled for accountability by <br />appropriate entity and cost center. Throughout the presale planning <br />and preparation of each Auction, the Auction Coordinator will assist <br />the CITY with the timing of the moving of merchandise to the auction <br />site, the layout of vehicle equipment and merchandise to enhance the <br />perceived value of merchandise and to increase revenues for the City, <br />and the obtaining of good appraisals for seized and forfeited goods. <br />
