<br /> L/ S/f <br /> -2- <br />1.5 AUCTIONEER will provide all equipment necessary for the conduct <br />of each auction as specifically described in AUCTIONEER's proposal. <br />:This equipment will include: a public address system¡ computers, <br />printers, appropriate software, and computer paper¡ cash regist,ers ¡ <br />calculators¡ office equipment and supplies¡ copy machine¡ fax machine¡ <br />sale site signage¡ telephones¡ radios¡ jewelry and gun security display <br />pouches and sealers¡ locking jewelry cases¡ lot tags¡ vehicle lot tags¡ <br />bidder registration cards¡ and audio visual equipment. AUCTIONEER will <br />provide on-site back-up electronic equipment in case of failure of any <br />~. of its first-line equip~ent. AUCTIONEER's computers will be equipped <br />to provide back-up of a: information pertaining to the auction, <br />1.6 AUCTIONEER will provide advertising for each auction at its <br />expense and in accordance with State law as follows: <br /> (a) place display advertising in the San Marcos Dailv Record, <br /> Austin American Statesman, San Antonio Express News, Sequin <br /> Gazette Enterprise and the New Braunfels Herald Zeitunq to <br /> run at least two Sundays prior to each auction¡ <br /> (b) place advertising in appropriate trade publications as <br /> appropriate to the assets¡ <br /> (c) develop brochures which will contain a minimum of eight' (8) <br /> high quality photographs as the merchandise. warrants and be <br /> printed in two colors¡ <br /> (d) will submit brQchures for CITY approval, and after obtaining <br /> CITY approval, mail a minimum of 3,000 brochures to <br /> interested parties on AUCTIONEER's mailing list and to <br /> prospective bidders as identified by the CITY no later than <br /> two weeks prior to each auction. <br />1.7 AUCTIONEER will provide bidder registration cards at each auction <br />which specify terms and conditions of the sale, including a provision <br />that all items will be sold on a "where; is-as is" basis and that there <br />shall be no warranties of any kind either expressed or implied, and <br />specifically no warranty of merchantibility or fitness for any <br />particular purpose. AUCTIONEER understands and agrees that AUCTIONEER <br />will require that each bidder read and sign a copy of these terms and <br />conditions and will announce these requirements prior to and repeatedly <br />throughout each auction. <br />1.8 On the day of each auction, the AUCTIONEER will: <br /> (a) arrive with personnel at the auction site in sufficient time <br /> (usually 7:00 a.m.) to establish cashiers' banks, connect <br /> computers, printers, office machines and related equipment <br /> and prepare for the registration of bidders¡ <br /> (b) begin registering bidders (usually 8:00 a.m.) by verifying <br /> bidder's identification with driver's license, establishing <br /> bona fide methods of payment, determining tax status, <br /> completing sales tax documents¡ handing out bid numbers and <br />
