<br /> . r <br /> < 53 <br /> This AGREEMENT is made this the 2nd d§tyof May , <br /> 1994, between the CITY OF SAN MARCOS, TEXAS, hereinafter referred <br /> to as IICITYII, 630 East Hopkins, San Marcos, Texas 78666, and BEATY <br /> SAUNDERS ARCHITECTS, 2322 San Pedro Avenue, San Antonio, Texas, <br /> 78212 hereinafter referred to as II ARCHITECT", for architectural <br /> services in connection with the renovation of City facilities in <br /> San Marcos, Texas, including remodeling for Americans With <br /> Disabilities Act (IIADAII) compliance. <br /> WITNESSETH: CITY and ARCHITECT do hereby agree as follows: <br />I ARTICLE l <br />I <br /> ARCHITECT'S SERVICES AND RESPONSIBILITIES <br /> ARCHITECT will be responsible for the proper, accurate and <br /> adequate design and preparation of plans and specifications and <br /> other construction contract documents and for contract <br /> administration for the renovation of City facilities, hereinafter <br /> referred to as the IIproject.1I <br /> Any provisions in this Agreement pertaining to CITY's review, <br /> approval and/or acceptance of plans, specifications, construction <br /> contract documents, or other written materials prepared by <br /> ARCHITECT and/or its consultants, Contractors, and subcontractors <br /> in connection with this Project will not dim:imish ARCHITECT's <br /> responsibility therefor. The ARCHITECT's Basic Services shall <br /> consist of the following phases described in Paragraphs 1.0 <br /> through 1 . 3 and include normal architectural, structural, <br /> mechanical, civil and electrical engineering services. Certain <br /> portions of the ARCHITECT's Basic Services are to be performed <br /> through the following consulting disciplines as subcontractors to <br /> the ARCHITECT: <br /> (1) Mechanical/Electrical/Plumbing (M/E/P) <br /> i (2) Structural <br /> I (3) Civil <br /> ¡ <br /> l_O STANDARDS OF PERFORMANCE, QUALITY CONTROL AND SCHEDULING <br /> 1. 0.1 In the performance of all architectural services in <br /> connection with this Agreement, the ARCHITECT will use that degree <br /> of care and skill ordinarily exercised for similar projects by <br /> professional architects who possess special expertise in the type <br /> of work involved in this Project. <br /> 1. 0.2 The ARCHITECT will assemble a Project team, comprised of <br /> the City's representative and a firm representative from each <br /> major consulting discipline. The ARCHITECT will, during the <br /> initial Project phase, meet with the Project team representatives <br /> to set the design and production schedule and parameters for all <br />
