ORDINANCE NO. 2003 - 50 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS AMENDING <br />CHAPTER 86, UTILITIES, OF THE CITY CODE TO <br />REVISE LOCAL INDUSTRIAL WASTEWATER <br />DISCHARGE LIMITS, PROVIDE FOR <br />ADMINISTRATIVE REMEDIES, UPDATE <br />DEFINITIONS AND ABBREVIATIONS, AND MAKE <br />OTHER ADMINISTRATIVE CHANGES; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />50. <br /> <br />RECITALS: <br /> <br /> 1. State and federal regulations require the City to periodically review and revise the <br />teclmically based local limits for contaminants entering the City's wastewater system. <br /> <br /> 2. The Texas Commission for Enviromnental Quality (TCEQ) has required the City to <br />include certain administrative changes and suggested other administrative changes pertaining to the <br />City's industrial wastewater discharge regulations. <br /> <br /> 3. TCEQ has reviewed and approved the revisions to the City's Industrial Waste Discharge <br />program, contained in Division 2 of Article 3 of Chapter 86 of the City Code. <br /> <br /> 4. The City Council wishes to revise Chapter 86, Utilities, Regulations of the City Code to <br />comply with cun'ent state and federal requirements. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION 1. Chapter 86, Utilities, Article 3, Division 2, Iudustrial Waste Discharge <br />Regulations is deleted entirely and replaced by a new Division 2 to read as follows: <br /> <br />DIVISION 2. INDUSTRIAL WASTE DISCHARGE REGULATIONS <br /> <br />Sec. 86.110. Purpose and Applicability. <br /> <br />(a) Purpose. This division adopts by reference the applicable regulations of Title 40 Code of <br />Federal Regulations, Part 403, "General Pretreatment Regulations for Existing and New Sources <br />of Pollution," and other applicable State and Federal laws, including but not limited to, the Clean <br />Water Act. These regulations are herein referred to as General Pretmatment Regulations. This <br />division forms the basis of the city's pretreatment program to regulate nondomestic discharges <br />to its sewage collection and treatment facilities. Regulation of such discharges is necessary to <br />prevent interference with the operation of the facilities, to prevent pass-ttu'ough of the treatment <br />facilities, to enable the Publicly Owned Treatment Works (POTW) to comply with all applicable <br /> <br /> <br />
