The maximum concentration of waste constituents, other than those <br />named in this section, acceptable for discharge into the sm~itary sewer system ~vill be those levels <br />as specified by the control authority and/or approval authority. <br /> <br />(d) Removal credits. Any person wishing to apply for removal credit, as described in 40 CFR <br />403, may do so provided the person assumes responsibility for all costs incurred, including those <br />by the city, and states this responsibility to the director in writing. Any removal credit granted <br />shall be in accordance with the procedures set fo~th in 40 CFR 403, as amended. <br /> <br />(e) Pass through. A user may not introduce into a POTW any pollutants that cause pass tlu'ough <br />or interference. A user shall have an affim~ative defense in any action brought against it alleging <br />a violation of this subsection, if it did not know or have reason to to know that its discharge, <br />alone or in conjuction with a discharge or discharges from other sources, would cause pass <br />through or interference. <br /> <br />(f) Bypass. Bypass is prohibited unless the industrial user meets the conditions established in 40 <br />CFR 403.17(d)(1). <br /> <br />(g) Dilution is prohibited as a substitute for treatment. No industrial user shall ever increase the <br />use of process water or in any other way to attempt to dilute a discharge as a partial or complete <br />substitute for adequate treatment to achieve compliance with the conditions contained in this <br />document, and/or with the Federal Categorical limitation, unless expressly authorized to do so <br />by an applicable pretreatment standard or requirement. <br /> <br />(h) Upon the promulgation of the Federal Categorical Pretreatment Standards for a particular <br />industa'ial subcategory, the Federal Standard, if more stringent than limitations imposed under <br />tiffs division for sources in that subcategory shall irmnediately supersede the limitations imposed <br />under this division. The director shall notify all affected Categorical Industrial Users of the <br />applicable reporting requirements under Title 40 CFR Section 403.12. <br /> <br />(i) Act of God defense. The act of God defense constitutes a statutory affirmative defense (Texas <br />Water Code Section 7.251) in an action brought in municipal or State court.
