Sewer system means all of the property involved in the operation of a sanitary sewer utility. It includes land, wastewater lines and appurtenances, pumping stations, treatment works, wastewater treatment plants and general property. Shall is mandatory; may is permissive. SIC (standard industrial classification) means a classification pursuant to the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget. Significant industrial user means: (1) Except as provided in paragraph (2) of this definition: (A) All industrial users subject to Categorical Pretmatment Standards under 40 CFR 403.6 and 40 CFR chapter I, subchapter N; and (B) Any other industrial user that: discharges and average of 25,000 gallons per day or mom of process wastewater to the POTW (excluding sanitm% non contact cooling and boiler blowdown wastewater); contributes a process wastestream which makes up 5 percent of more of the average d~3' weather hydraulic or organic capacity of POTW treatment plant; or is designated as such by the Control Authority as defined in 40 CFR 403.12(a) on the basis that the industrial user has a reasonable potential for adversely affecting the POTW's operation or tbr violating a pretreatment standard or requirement (in accordance with 40 CFR 403.8(f)(6)). (2) Upon a finding that an industrial user meeting the criteria in paragraph (1)(B) of this definition has no reasonable potential tbr adversely affecting the POTW's operation or for violating any pretreatment standard or requirement, the control authority (as defined in 40 CFR 403.12(a)) may at any time, on its own initiative or in response to a petition received from an industrial user or POTW, and in accordance with 40 CFR 403.8(f)(6), determine that such industrial user is not a significant industrial user. Slug loading means any pollmant (including biochemical oxygen demand (BOD)) released in a discharge at a fiow rate or concentration that will cause interference with the operation of the treatment works. Slug discharge means a discharge of a non-routine, episodic nature, including but not linfited to an accidental spill or a non-customary batch discharge. Significant noncompliance means a violation by an industrial user that meets one or more of the criteria established in 40 CFR 403.8(f)(2)(vii). Solid ~vaste means any garbage, refuse, sludge and other discarded materials, including solid, liquid, semisolid or contained gaseous material resulting from industrial, municipal, commercial
