Sewer system means all of the property involved in the operation of a sanitary sewer utility. It <br />includes land, wastewater lines and appurtenances, pumping stations, treatment works, <br />wastewater treatment plants and general property. <br /> <br />Shall is mandatory; may is permissive. <br /> <br />SIC (standard industrial classification) means a classification pursuant to the Standard Industrial <br />Classification Manual issued by the Executive Office of the President, Office of Management <br />and Budget. <br /> <br />Significant industrial user means: <br /> <br />(1) Except as provided in paragraph (2) of this definition: <br /> <br />(A) All industrial users subject to Categorical Pretmatment Standards under 40 CFR <br />403.6 and 40 CFR chapter I, subchapter N; and <br /> <br />(B) Any other industrial user that: discharges and average of 25,000 gallons per day or <br />mom of process wastewater to the POTW (excluding sanitm% non contact cooling and boiler <br />blowdown wastewater); contributes a process wastestream which makes up 5 percent of <br />more of the average d~3' weather hydraulic or organic capacity of POTW treatment plant; or <br />is designated as such by the Control Authority as defined in 40 CFR 403.12(a) on the basis <br />that the industrial user has a reasonable potential for adversely affecting the POTW's <br />operation or tbr violating a pretreatment standard or requirement (in accordance with 40 CFR <br />403.8(f)(6)). <br /> <br /> (2) Upon a finding that an industrial user meeting the criteria in paragraph (1)(B) of this <br />definition has no reasonable potential tbr adversely affecting the POTW's operation or for <br />violating any pretreatment standard or requirement, the control authority (as defined in 40 CFR <br />403.12(a)) may at any time, on its own initiative or in response to a petition received from an <br />industrial user or POTW, and in accordance with 40 CFR 403.8(f)(6), determine that such <br />industrial user is not a significant industrial user. <br /> <br />Slug loading means any pollmant (including biochemical oxygen demand (BOD)) released in <br />a discharge at a fiow rate or concentration that will cause interference with the operation of the <br />treatment works. <br /> <br />Slug discharge means a discharge of a non-routine, episodic nature, including but not linfited to <br />an accidental spill or a non-customary batch discharge. <br /> <br />Significant noncompliance means a violation by an industrial user that meets one or more of the <br />criteria established in 40 CFR 403.8(f)(2)(vii). <br /> <br />Solid ~vaste means any garbage, refuse, sludge and other discarded materials, including solid, <br />liquid, semisolid or contained gaseous material resulting from industrial, municipal, commercial <br /> <br /> <br />
