to- loqM 1.5 ADDITIONAL SERVICES Compensation to the CONSULTANT for additional services will be payable only for (1) services described as such in this Agreement, and (2) substantial deviations from the scope of services described in Article 1 of this Agreement or contained in the CONSULTANT's proposal to the CITY. Additional Services will be provided by CONSULTANT only if authorized or confirmed in writing by the CITY and compensation will be in addition to that specified for basic services, in accordance with Subsection 13.2 of this Agreement. Additional services will include resident project representation as identified in Subsection 1.3.19 of this Agreement. ARTICLE 2 THE CITY'S RESPONSIBILITIES The CITY will: 2.1 Provide a budget for the Project which will include contingencies for bidding, changes in the work during construction, and other costs which are the responsibility of the CITY, including those described in this Article 2 and in Subsection 3.1.2. The CONSULTANT will accept the CITY's authorization to bid the Project as evidence that arrangements exist for fulfillment of the financial obligations assumed by the CITY for this Project. 2.2 Designate a representative authorized to act in the CITY's behalf with respect to the Project. The CITY and/or such authorized representative will examine the documents submitted BY the CONSULTANT and will render responses pertaining to the documents promptly and provide CONSULTANT with requested data or information in the CITY's possession relating to the Project. 2.3 Provide access to and make all necessary provisions for the CONSULTANT to enter upon public and private property as required for the CONSULTANT to perform its services under this Agreement. 2.4 Acquire all land and right-of-way required for completion of the Project. 2.5 Furnish all legal, accounting and insurance counseling services as may be necessary at any time for ~ the proj ect, including such auditing services as the CITY may require to ascertain how or for what purposes the Contractor used the money paid by or on behalf of the CITY. 2.6 Furnish required information and services and will render responses and conduct its review of written materials as expeditiously as possible. 2.7 Pay all costs incident to obtaining bids from Contractors (e.g., legal notice requirements and the provision of City facilities for pre-bid conferences). -14-
