<br /> to- loqM <br /> 1.5 ADDITIONAL SERVICES <br /> Compensation to the CONSULTANT for additional services will be <br /> payable only for (1) services described as such in this Agreement, and <br /> (2) substantial deviations from the scope of services described in <br /> Article 1 of this Agreement or contained in the CONSULTANT's proposal <br /> to the CITY. Additional Services will be provided by CONSULTANT only <br /> if authorized or confirmed in writing by the CITY and compensation will <br /> be in addition to that specified for basic services, in accordance with <br /> Subsection 13.2 of this Agreement. Additional services will include <br /> resident project representation as identified in Subsection 1.3.19 of <br /> this Agreement. <br /> ARTICLE 2 <br /> THE CITY'S RESPONSIBILITIES <br /> The CITY will: <br /> 2.1 Provide a budget for the Project which will include <br /> contingencies for bidding, changes in the work during construction, <br /> and other costs which are the responsibility of the CITY, including <br /> those described in this Article 2 and in Subsection 3.1.2. The <br /> CONSULTANT will accept the CITY's authorization to bid the Project as <br /> evidence that arrangements exist for fulfillment of the financial <br /> obligations assumed by the CITY for this Project. <br /> 2.2 Designate a representative authorized to act in the CITY's <br /> behalf with respect to the Project. The CITY and/or such authorized <br /> representative will examine the documents submitted BY the CONSULTANT <br /> and will render responses pertaining to the documents promptly and <br /> provide CONSULTANT with requested data or information in the CITY's <br /> possession relating to the Project. <br /> 2.3 Provide access to and make all necessary provisions for the <br /> CONSULTANT to enter upon public and private property as required for <br /> the CONSULTANT to perform its services under this Agreement. <br /> 2.4 Acquire all land and right-of-way required for completion of <br /> the Project. <br /> 2.5 Furnish all legal, accounting and insurance counseling <br /> services as may be necessary at any time for ~ the proj ect, including <br /> such auditing services as the CITY may require to ascertain how or for <br /> what purposes the Contractor used the money paid by or on behalf of the <br /> CITY. <br /> 2.6 Furnish required information and services and will render <br /> responses and conduct its review of written materials as expeditiously <br /> as possible. <br /> 2.7 Pay all costs incident to obtaining bids from Contractors <br /> (e.g., legal notice requirements and the provision of City facilities <br /> for pre-bid conferences). <br /> -14- <br />
