<br /> /O&[£ <br /> 1.3.7 Conduct a pre-construction conference with the Contractor and <br /> members of CITY's staff, to establish construction scheduleS and to <br /> identify key representatives of the parties and lines of communication. <br /> 1.3.8 Make on-site observations of all phases of the Project at least <br /> monthly to ensure familiarity with the progress and quality of the <br /> Contractor's work, to determine if the work is proceeding in acceptable <br /> conformance with the Construction contract documents, and to review the <br /> work with the CITY's designated representatives. On the basis of such <br /> on-site observations by the CONSULTANT, the CONSULTANT will keep the <br /> CITY informed of the progress and quality of the work through written <br /> field reports and monthly meetings with the CITY's representative. In <br /> performing these services, the CONSULTANT will endeavor to protect the <br /> CITY against defects and deficiencies in the quality and quantity of <br /> the work of the Contractor if such are within its knowledge or should <br /> reasonably have been within its knowledge. The CONSULTANT will also be <br /> reasonably available to perform site visitations at the specific <br /> request of the CITY by the next business day after a request is made. <br /> 1.3.9 Exercise its authority on behalf of CITY in accordance herewith <br /> and particularly during the construction phase so that all work <br /> perfomed by the. CONTRACTOR results in a project completed in accordance <br /> with the contract documents, and during any phase should the CONSULTANT <br /> become aware of Contractor's utilization of means, methods, techniques, <br /> sequences and/or procedures of construction which, in CONSULTANT's <br /> opinion, will not result in completion of the Project in accordance <br /> with the contract documents or which are unsafe, CONSULTANT will <br /> immediately inform the CITY and will take all necessary actiqn which <br /> the CONSULTANT is authorized under this agreement tq take to correct <br /> the matter. In such situations, the CONSULTANT will have the right and <br /> power to immediately cease the work by Contractor on the Project. <br /> However, the CONSULTANT will not have control or charge of and will not <br /> be responsible for construction means, methods, techniques, sequences <br /> or procedures, or for safety precautions and programs in connection <br /> with the work, for the acts or omissions of the Contractor, <br /> subcontractors or any other persons performing any of the work, or for <br /> the failure of any of them to carry out the work in accordance with the <br /> contract documents unless such acts or omissions are due to negligence <br /> of the CONSULTANT or are acts or omissions under its control. <br /> l.3.10 Have access to the work whe"never it is in preparation or <br /> progress. <br /> 1.3.1l Issue all instructions to the Contractor requested by the <br /> CITY and will prepare change orders in triplicate originals as required <br /> for the CITY's approval and execution in accordance with the contract <br /> documents but will not issue change orders not previously approved in <br /> writing by CITY, and no course of conduct on the part of CONSULTANT or <br /> CITY will amend, waive or alter this provision. Routine change orders <br /> are those not requiring additional design but requiring minor changes <br /> in the construction cost or time. <br /> 1.3.12 Review and make all decisions regarding the approval or <br /> taking of other appropriate action upon the Contractor's submittals, <br /> including but not limited to shop drawings, product data and samples, <br /> -6- <br />
