Jo,Þ '. will be reviewed by the FAA project manager and must be approved along with the final plans and specifications for construction. 1..3 PART A AND PART B- PHASE 3 - CONSTRUCTION ADMINISTRATION AND RESIDENT CONSTRUCTION INSPECTION Upon approval of the construction plans, specifications, and contract documents by the CITY and the FAA for each of Part A and Part B of the Project, Phase 3 for the respective part of the Project will commence, and the CONSULTANT will: 1..3.1. Assist the CITY in the advertisement of the Proj ect for bids. The CONSULTANT will distribute copies of the contract documents to prospective bidders. 1..3.2 Assist the CITY in holding a pre-bid conference. 1..3.3 Assist the CITY in filing documents required for the approval of governmental authorities having jurisdiction over the Project and assist the CITY in the preparation of the formal construction Contract Documents. .' 1..3.4 Assist in obtaining bids, opening bids, tabulating bids, and in awarding the contract for construction. The CONSULTANT will assist the CITY in reviewing the Statement of Bidder's Qualifications, financial statements of bidders (if required), lists of bidders' proposed subcontractors, and will make a written recommendation to CITY regarding award of bid. CONSULTANT will also answer all questions of prospective or potential bidders and will make all necessary clarifications and interpretations of the contract documents. However, CONSULTANT will have no-authority to issue a Notice To Proceed to the Contractor. 1..3.5 Unless otherwise provided in this AGREEMENT and incorporated into the contract documents, provide administration of the contract for construction as set forth herein and in the contract documents approved by CITY. CONSULTANT's administration of the contract for construction will be provided in strict adherence with the contract documents and CONSULTANT will not pursue a course of conduct which might jeopardize any of CITY's rights thereunder. 1..3.6 Be a representative but not an agent of the CITY during the Construction Phase, and will advise and consult with the CITY. CITY's instructions to the Contractor will be forwarded through the CONSULTANT, unless (1) CONSULTANT is unavailable by telephonic communication or otherwise to issue instructions necessary for the proper progress and acceptance of work; (2) when jeopardy to life and/or property exists; or (3) when lack of instructions or unavailability of CONSULTANT will result in, in CITY's opinion, harm to CITY, in which case instructions may be forwarded directly to the Contractor by CITY. The CONSULTANT will have authority to act on behalf of the CITY only to the extent provided herein and in the contract documents unless otherwise modified in accordance with Section 1.3.17. Any instructions issued directly by CITY to Contractor shall be promptly communicated to CONSl}LTANT if the CONSULTANT was unavailable at the time of issuance of instructions. -5-
