<br /> Jo,Þ <br /> '. will be reviewed by the FAA project manager and must be approved along <br /> with the final plans and specifications for construction. <br /> 1..3 PART A AND PART B- PHASE 3 - CONSTRUCTION ADMINISTRATION AND <br /> RESIDENT CONSTRUCTION INSPECTION <br /> Upon approval of the construction plans, specifications, and <br /> contract documents by the CITY and the FAA for each of Part A and Part <br /> B of the Project, Phase 3 for the respective part of the Project will <br /> commence, and the CONSULTANT will: <br /> 1..3.1. Assist the CITY in the advertisement of the Proj ect for bids. <br /> The CONSULTANT will distribute copies of the contract documents to <br /> prospective bidders. <br /> 1..3.2 Assist the CITY in holding a pre-bid conference. <br /> 1..3.3 Assist the CITY in filing documents required for the approval of <br /> governmental authorities having jurisdiction over the Project and <br /> assist the CITY in the preparation of the formal construction Contract <br /> Documents. <br /> .' <br /> 1..3.4 Assist in obtaining bids, opening bids, tabulating bids, and in <br /> awarding the contract for construction. The CONSULTANT will assist the <br /> CITY in reviewing the Statement of Bidder's Qualifications, financial <br /> statements of bidders (if required), lists of bidders' proposed <br /> subcontractors, and will make a written recommendation to CITY <br /> regarding award of bid. CONSULTANT will also answer all questions of <br /> prospective or potential bidders and will make all necessary <br /> clarifications and interpretations of the contract documents. However, <br /> CONSULTANT will have no-authority to issue a Notice To Proceed to the <br /> Contractor. <br /> 1..3.5 Unless otherwise provided in this AGREEMENT and incorporated <br /> into the contract documents, provide administration of the contract for <br /> construction as set forth herein and in the contract documents approved <br /> by CITY. CONSULTANT's administration of the contract for construction <br /> will be provided in strict adherence with the contract documents and <br /> CONSULTANT will not pursue a course of conduct which might jeopardize <br /> any of CITY's rights thereunder. <br /> 1..3.6 Be a representative but not an agent of the CITY during the <br /> Construction Phase, and will advise and consult with the CITY. CITY's <br /> instructions to the Contractor will be forwarded through the <br /> CONSULTANT, unless (1) CONSULTANT is unavailable by telephonic <br /> communication or otherwise to issue instructions necessary for the <br /> proper progress and acceptance of work; (2) when jeopardy to life <br /> and/or property exists; or (3) when lack of instructions or <br /> unavailability of CONSULTANT will result in, in CITY's opinion, harm to <br /> CITY, in which case instructions may be forwarded directly to the <br /> Contractor by CITY. The CONSULTANT will have authority to act on behalf <br /> of the CITY only to the extent provided herein and in the contract <br /> documents unless otherwise modified in accordance with Section 1.3.17. <br /> Any instructions issued directly by CITY to Contractor shall be <br /> promptly communicated to CONSl}LTANT if the CONSULTANT was unavailable <br /> at the time of issuance of instructions. <br /> -5- <br />
