<br /> f 53 <br /> INTERLOCAL AGREEMENT FOR TEMPORARY LEASE OF PREMISES <br /> THIS AGREEMENT is made and entered into this 9th day of August, <br /> 1994, by and between the City of San Marcos, whose address is 630 East <br /> Hopkins Street, San Marcos, Texas 78666, hereinafter called "Lessor;" <br /> and HAYS COUNTY, whose address is County Courthouse, San Marcos, Texas <br /> 78667, hereinafter called "Lessee." <br /> .- In consideration of the mutual convenants to be performed, the <br /> ?arties hereto agree as follows: <br /> 1. DESCRIPTION OF LEASED PREMISES: Lessor does hereby lease, demise <br /> and let unto Lessee the ground floor interior of the Municipal Building <br /> situated in San Marcos, Texas, save and except the front lobby, <br /> elevator and stairwell common areas and being 9,000 square feet, more <br /> or less, with the address of 632A East Hopkins Street. <br /> 2. TERM: Eight 'weeks beginning on the ninth day of August, 1994, and <br /> terminating on the fourth day of October, 1994. <br /> 3. RENTAL: No rental is charged under this Agreement. <br /> <br /> 4. USE OF THE PREMISES: The Leased Premises shall be used as office <br /> and clinic space by the Lessee. The Leased Premises shall not be used <br /> for any other type of activity without the written< consent of the <br /> Lessor. <br /> 5. UTILITIES: Lessee shall promptly pay to the Lessor, upon receipt <br /> of a request by Lessor, twelve percent (12%) of the total monthly <br /> charge for natural gas service to the Public Works Office Complex and <br /> the Municipal Building, and shall pay all charges for electricity and <br /> telephone service furnished to the Leased Premises. The Lessor shall <br /> pay for water, wastewater and garbage service to the building. <br /> 6. INDEMNIFICATION AND INSURANCE: <br /> - a. Lessee shall indemnify and hold Lessor harmless from any and <br /> all claims (including attorney's fees) of others for injuries to <br /> persons or property arising out of Lessee's negligent conduct of its <br /> business operations on the Leased Premises. <br /> b. Lessee shall maintain adequate insurance on Lessee's personal <br /> property located within the Leased Premises. <br /> 7. ASSIGNMENT AND SUBLETTING: Lessee may not assign this Lease or <br /> sublet the Leased Premises, or any part thereof, except upon the prior <br /> written consent of the Lessor. <br />
