g()~ -4- The coordination and the submittal of final design drawings to TxDOT by the ENGINEER are included in ENGINEER's scope of work at no additional cost to the CITY. The ENGINEER will conduct a review meeting with the CITY prior to completion of the construction contract documents for each construction phase of the Project. The ENGINEER will prepare a final and detailed construction cost estimate for each construction phase of the Project and í present it along with the contract documents for the respective phase to the CITY for review and approval. 1. 3.3 Biddinq For each construction phase of the Project, the ENGINEER will, following the CITY's approval of the construction contract documents and of the latest detailed cost estimate for the respective phase of the Project, assist the City in obtaining bids, tabulating bids, and awarding the contract for construction; will be responsible for the printing and binding of the bid documents in a number to be determined by consultation with the CITY's representative, the distribution of the bid documents to prospective bidders and to plan rooms, and the issuance of addenda (if any) following CITY's prior approval; will assist the CITY in reviewing the Statements of Bidder's Qualifications, financial statements of bidders, lists of bidders' proposed subcontractors, and all other documents required to be submitted with the bids; will make a written recommendation to CITY regarding award of bid; and will conduct a pre-bid conference and answer all questions of prospective or potential bidders and CITY's staff and make all necessary clarifications and interpretations of the construction contract documents. However, ENGINEER will have no authority to issue a Notice To Proceed to any Contractor. 1.4 TASK 4 - CONSTRUCTION ADMINISTRATION The Construction Administration task for each construction phase will commence with the award of the construction contract and will terminate when that phase of the Project is accepted by the CITY. For each construction phase of the Project the ENGINEER will: 1.4.1 Unless otherwise provided in this Agreement and incorporated in the construction contract documents" provide administration of the construction contract as set forth herein and in the construction contract documents approved by the CITY; and provide administration of the contract for construction in strict adherence with the construction contract documents. ENGINEER will not pursue a course of conduct which might jeopardize any of the CITY's rights thereunder. Minor deviations from the construction contract documents that do not affect the validity of performance bond(s) are permitted.
