'i!DØ -3 - Project. The ENGINEER will design all improvements in compliance with the requirements of the Americans with Disabilities Act ( "ADA") . 1.2.3 At the conclusion of this work and prior to beginning the work specified in Section 1.3 of this Agreement, the ENGINEER will prepare a preliminary written opinion of probable construction cost for each block of the Project for the CITY's review and approval. 1. 2.4 The ENGINEER will meet with the Downtown Association of San Marcos to make a presentation regarding the completed preliminary design studies and opinion of probable construction cost. 1. 2.5 The CITY will determine whether to combine all three blocks into a single construction contract, or to separate the three blocks into two or three distinct phases of construction contracts, based on the ENGINEER's preliminary opinion of construction cost, and the availability of funding. 1.3 TASK 3 - FINAL DESIGN, CONSTRUcrION CONTRAcr DOCUMENTATION AND BIDDING 1.3.1 Final Desiqn ~ Based on the CITY's approval of the scope of work and the preliminary design documents prepared under Section 1.2 of this Agreement, and the CITY's determination of the phasing of construction of the Project, the ENGINEER will prepare, for review and approval by the CITY, final design drawings, technical specifications, and other documents for each phase of the Project for which the CITY issues a notice to proceed to the ENGINEER. 1. 3.2 Construction Contract Documents Based on the approved final qesign documents and any further adjustments authorized by the CITY in the scope, quality or budget of each construction phase of the Project, the ENGINEER will prepare construction contract documents using forms supplied by the CITY. These contract documents will include detailed plans and specifications required for the respective phase of the Project to be accurately bid and efficiently constructed. The ENGINEER will use its best professional judgment to create documents that comply with all applicable construction and development codes, local regulations and ordinances and other federal and state regulations which are known or which should reasonably be known to the ENGINEER including those required under the ADA and Article 9102, V.A.C.S., Texas Architectural Barriers Act. The ENGINEER will assist the CITY in the coordination of the Project with the Texas Department of Transportation ( " TxDOT") .
