The ENGINEER will design all improvements in compliance <br /> with the requirements of the Americans with Disabilities Act <br /> ( "ADA") . <br /> 1.2.3 At the conclusion of this work and prior to beginning <br /> the work specified in Section 1.3 of this Agreement, the ENGINEER <br /> will prepare a preliminary written opinion of probable <br /> construction cost for each block of the Project for the CITY's <br /> review and approval. <br /> 1. 2.4 The ENGINEER will meet with the Downtown Association of <br /> San Marcos to make a presentation regarding the completed <br /> preliminary design studies and opinion of probable construction <br /> cost. <br /> 1. 2.5 The CITY will determine whether to combine all three <br /> blocks into a single construction contract, or to separate the <br /> three blocks into two or three distinct phases of construction <br /> contracts, based on the ENGINEER's preliminary opinion of <br /> construction cost, and the availability of funding. <br /> 1.3 TASK 3 - FINAL DESIGN, CONSTRUcrION CONTRAcr <br /> DOCUMENTATION AND BIDDING <br /> 1.3.1 Final Desiqn <br /> ~ <br /> Based on the CITY's approval of the scope of work and the <br /> preliminary design documents prepared under Section 1.2 of this <br /> Agreement, and the CITY's determination of the phasing of <br /> construction of the Project, the ENGINEER will prepare, for review <br /> and approval by the CITY, final design drawings, technical <br /> specifications, and other documents for each phase of the Project <br /> for which the CITY issues a notice to proceed to the ENGINEER. <br /> 1. 3.2 Construction Contract Documents <br /> Based on the approved final qesign documents and any further <br /> adjustments authorized by the CITY in the scope, quality or budget <br /> of each construction phase of the Project, the ENGINEER will <br /> prepare construction contract documents using forms supplied by <br /> the CITY. These contract documents will include detailed plans <br /> and specifications required for the respective phase of the <br /> Project to be accurately bid and efficiently constructed. <br /> The ENGINEER will use its best professional judgment to <br /> create documents that comply with all applicable construction and <br /> development codes, local regulations and ordinances and other <br /> federal and state regulations which are known or which should <br /> reasonably be known to the ENGINEER including those required under <br /> the ADA and Article 9102, V.A.C.S., Texas Architectural Barriers <br /> Act. <br /> The ENGINEER will assist the CITY in the coordination of the <br /> Project with the Texas Department of Transportation ( " TxDOT") . <br />
