<br /> " " <br /> 20 <br />, <br /> This AGREEMENT is made this the 25th day of October , <br /> 1994, between the CITY OF SAN MARCOS, TEXAS, hereinafter referred <br /> to as " CITY", 630 East Hopkins, San Marcos, Texas 78666, and BEATY <br /> SAUNDERS ARCHITECTS INC., St. Paul Square, 1148 East Commerce <br /> Street, San Antonio, Texas, 78205 hereinafter referred to as <br /> "ARCHITECT", for architectural services in connection with the <br /> construction of the San Marcos Activity Center Project, <br />- CITY and ARCHITECT do hereby agree as follows: <br />I WITNESSETH: <br /> ARTICLE 1 <br /> ARCHITECT'S SERVICES AND RESPONSIBILITIES <br /> 1.0 STANDARDS OF PERFORMANCE, QUALITY CONTROL AND SCHEDULING <br /> 1. 0.1 ARCHITECT will be responsible for the proper, accurate <br /> and adequate design and preparation of plans and specifications <br /> and other construction contract documents and for contract <br /> administration for the construction of the San Marcos Activity <br /> Center, hereinafter referred to as the "Project. " <br /> 1. 0.2 Any provisions in this Agreement pertaining to CITY's <br /> review, approval and/or acceptance of plans, specifications, <br /> construction contract documents, or other written materials <br /> prepared by ARCHITECT and/or its consultants, contractors, and <br /> subcontractors in connection with this Project will not diminish <br /> ARCHITECT's responsibility therefor. The ARCHITECT's Basic <br /> Services will consist of the services described in Sections 1.0 <br /> through 1.3 and include normal architectural, structural, <br /> mechanical, civil and electrical engineering services- Certain <br /> portions of the ARCHITECT's Basic Services are to be performed <br /> through the following consulting disciplines as subcontractors to <br /> the ARCHITECT: <br /> (1) Mechanical/Electrical/Pl~mbing (M/E/P) including <br />\ <br />I swimming pool design <br /> (2) Structural <br /> (3) Civil <br /> (4) Commercial Kitchen <br /> (5) Landscaping <br /> (6) Interior Design and Furniture Selection <br /> 1. 0.3 The performance of all architectural and engineering <br /> services in connection with this Agreement will be by persons <br /> appropriately licensed or registered under State laws governing <br /> the respective consulting disciplines. The ARCHITECT will use <br /> that degree of care and skill ordinarily exercised for similar <br /> projects by professional architects who possess special expertise <br /> in the type of work involved in this Project. <br />
