s/?~ 3, GOVE&";'~~CE. 3.1. 0ovemin~ Powers. The Parties will retain their own governing structure and maintain local control. The Parties agree to cooperate in carrying out this Contract. The Parties will discharge their duties and responsibilities as set forth in statute and regulation. In addition to its current statutory powers, the Edwards District will seek legislative authority to implement powers analogous and parallel to powers of districts organized under Chapter 52 of the Texas Water Code. 3.2 Geo~raphic Boundary. The geographic boundary encompassed by this Contract is equivalent to the cumulative area of the counties covered by each Party's geographic jurisdiction or boundary under law. 3.3 Liaison Committee. The Edwards Aquifer Liaison Committee ("Liaison Committee") shall function as a coordinating committee among the Parties to this Contr'!-c~, Each District will appoint a minimum of one representative- per county to the Liaison Committee. with criteria for appointment to be determined by each county. The Liaison Committee will meet at least quarterly or as needed to facilitate communication, cooperation. and implementation of policy matters under this Contract. The Liaison Committee has no governance powers in law, The, Parties may create working groups to the Liaison Committee to consider technical and other issues. The Liaison Committee will coordinate water planning efforts with other regional entities, including, but not limited to, rivet authorities, other water districts. and water purveyors in the Aquifer region. 4. FINANCING STRUCI'URE. In general, the Parties agree that the overall fmancing strUcrure for water management administration, water supplies, water markets, recharge or surface water projects, and other similar projects shall be based upon the guiding principle that "Those who benefit -- pay." Projects to enhance recharge, to develop surface water supplies, to increase water conservation, and to achieve other purposes will be funded by Parties to this Contract in proportion to benefits that each Parry will gain by each project. 4.1. Ad Valorem Taxation. All Parties will levy and collect ad valorem taxes at the rates set by the respective District. 4.2. Production Fees. ~ 4.2.1. The Edwards District may request starutory authority to levy and collect production fees in addition to ad valorem taxes within its District. 4.2.2. The Medina District and the Uvalde District do not contemplate collecting production fees. except as may be allowed under Section 4.3 of this Contract. - 3 -
