In addition to other penalties <br />assessed, such a person shall be prohibited for a period of <br />ninety (90) days from the last date of the offense from <br />applying for or being issued a license for the performance <br />of electrical work within the city. <br /> <br />(13) To break, change, destroy, tear, mutilate, cover or <br />otherwise deface or injure any' official notice or seal <br />posted by the electrical inspector. <br /> <br />Sec. 5-~77 to 5-~80. Reserved. <br /> <br /> <br />SECTION 2. That the provisions of Article III, Flood Damage <br />Prevention, of Chapter 5 of the San Marcos Code of Ordinances are <br />transferred to a new Chapter lOA of the Code of Ordinances, titled <br />"Flood Damage Prevention," and with Sections 5-46 through 5-68 <br />being renumbered respectively within this new chapter as Sections <br />10A-l through 10A-23. <br />~ <br />SECTION 3. That the provisions of Article V, Standards for <br />Public Right-of-Way Access, of Chapter 5 of the San Marcos Code of <br />Ordinances are transferred to a new Article V of Chapter 25, <br />Streets and Sidewalks, of the San Marcos Code of Ordinances, with <br />sections 5-100 through 5~125 being renumbered respectively within <br />this new article as sections 25-50 through 25-75. <br /> <br />SECTION 4. That the provisions of Article VI, Specifications <br />for Off-Street Parking Lot Pavement Construction, of Chapter 5 of <br />, the San Marcos Code of Ordinances are transferred to a new Article <br />VI of Chapter 25, Streets. and sidewa~ks, of the San Marcos Code of <br />Ordinances, with Sections 5-126 through 5-135 being renumbered <br />respectively within this new article as sections 25-76 through 25- <br />85. <br /> <br />SECTION 5. That the provisions of Appendix I, Public Right- <br />of-Way Construction Ordinance, of the San Marcos Code of Ordinances <br />are transferred to a new Article IV of Chapter 25, Streets and <br />Sidewalks, of the San Marcos Code of Ordinances, with sections 100, <br />200,300,400 and 500 being renumbered respectively within this new <br />article as sections 25-45 through 25-49, and with section 600 of <br />Appendix I being repealed. <br /> <br />SECTION 6. That the title of Chapter 25 of the San Marcos <br />Code of Ordinances is changed to ~'Streets, Sidewalks, Right-of-Way <br />Construction and Off-Street Parking". <br /> <br />SECTION 7. That if any word, phrase, clause, sentence, <br />section, or portion of this ordinance or of any document or code <br />adopted by reference herein is found by a court of competent <br />jurisdiction to be unconstitutional or unenforceable for any <br />reason, the remaining provisions of this ordinance or of such <br />document or code shall remain in effect. <br /> <br />SECTION 8. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed <br />including but not limited to all of the following Chapters in the <br />San Marcos Code of Ordinances: Chapter 5, Buildings and Building <br />Regulations; Chapter 9, Electrical Code; Chapter 13~, Heating and <br />Air Conditioning; Chapter 14, Housing Code; Chapter 20, Plumbing <br />and Gas; and Chapter 24~ Refrigeration. Provided, however, that <br />all examination, licensing, permit, plan review and inspection fees <br />previously established are continued in effect, and that such <br />ordinances as applied to permits issued before the effective date <br />of this ordinance are saved from repeal and continued in effect <br />during the term of such permits. <br />
