RESOLUTION 2013 -13R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AMENDMENT NO. 1 TO THE THIRD <br />AMENDED AND RESTATED CONTRACT FOR COLLECTION AND <br />DISPOSAL OF SOLID WASTE AND RECYCLABLE MATERIALS <br />BETWEEN THE CITY AND TEXAS DISPOSAL SYSTEMS, INC.; <br />AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO <br />EXECUTE THIS AMENDMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br />1. The City Council approved a Third Amended and Restated Contract (the <br />Contract ") for Collection and Disposal of Solid Waste and Recyclable Materials with Texas <br />Disposal Systems, Inc. ( "TDS ") for the provision of solid waste and recyclable materials <br />collection and disposal services on December 6, 2011. <br />2. Both parties agree to amend the Contract to adjust the annual rate charged by TDS <br />in accordance with the Contract. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Amendment No. 1 to the Third Amended and Restated <br />Contract for Collection and Disposal of Solid Waste and Recyclable Materials between the City <br />and TDS is approved. <br />PART 2. The City Manager or his designee is authorized to execute the Amendment <br />on behalf of the City. <br />PART 3.
