Mr. Brown seconded the motion. <br />On roll call, the following vote was recorded: <br /> <br />AYE: Brown, James, Stokes <br /> <br />NAY: Cavazos, Norris, Tarbut%on <br /> <br />The motion failed. <br /> <br />Mr. Stokes introduced for consideration a Resolution approving a contract <br />between the City and Chastain and Associates, the caption of which was read <br />as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A CONTRACT BETWEEN SAID CITY AND CHASTAIN AND ASSOCIATES <br />FOR ASSISTANCE IN COMPLETION OF PERSONNEL MANAGEMENT AND TRAINING <br />ACTIVITIES PURSUANT TO THE SAN MARCOS PERSONNEL IMPROVEMENT PROGRA~; <br />AUTHORIZING THE CITY MANAGER OF SAID CITY TO EXECUTE SAID CONTRACT <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cavazos moved to disapprove the Resolution. Mrs. Norris seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: Cavazos, Norris <br /> <br />NAY: Brown, James, Stokes, Tarbutton <br /> <br />A lengthy discussion followed among the Council as to the need of this <br />contract. <br /> <br />Mr. Stokes then reintroduced item #15 for reconsideration, which was to <br />consider a Resolution approving a contract between the City and the Texas <br />Department of Community Affairs. Mr. Brown moved to adopt the Resolution. <br />Mr. James seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: Brown, James, Stokes, Tarbutton <br /> <br />NAY: Cavazos, Norris <br /> <br />On consideration of the Resolution approving a contract between the City <br />and Chastain and Associates, Mr. Tarbutton moved to table this item until <br />March 12th, when Ms. Chastain would be present to address the Council. <br />Mr. James seconded the motion, which passed unanimously. <br /> <br />Mr. Stokes introduced for consideration the personnel plan. Mrs. Norris <br />stated that she would like to see a change made on page XI-4, b., 4 to <br />read, "The Board convenes and delivers a written recommendation within ten <br />days of the hearing. The recommendation of the Personnel Appeals Board is <br />then forwarded to the City Manager for the final decision." Mr. Cavazos <br />asked what would happen if the grievance is against the City Manager. Mr. <br />Stokes stated that the City Manager should have the final word concerning <br />employees. The City Manager stated that he would have problems with action <br />going before COuncil on employees. Mr. Stokes stated that Council should <br />get a copy only of the report from the Personnel Appeals Board. Mrs. ~Norris <br />then moved to have the wording read as follows: "The Board convenes and <br />delivers a written recommendation within ten days of the hearing. The <br />recommendation of the Personnel Appeals Board is forwarded to the City <br />Manager (with copies going to the City Council) and the City Manager makes <br />the final decision." Mr. Tarbutton seconded the motion. On roll call, the <br />following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />James, Stokes, Norris, Tarbutton <br /> <br />Brown, Cavazos <br /> <br />Mr. James then moved to change page XI-4, c. to read: "The Board will be <br />comprised of 3 members. These persons are appointed by the Council as 1 <br />from the citizen-employee group, 1 from the citizen-employer group and 1 <br />from the citizen-professional group." and to delete the following words <br />from the last sentence in the same paragraph: "nor shall they hold <br />appointments to any other City board, commission or committee."
