CIJ-S CITY LIMITS I AND PROVIDING REGULATIONS; lL';¡f ;:E 5b CHANGING THE WORD HOGS TO SWINE; PROVIDING FOR Q RABIES TESTING AND QUARANTINE; SETTING FEES; PROVIDING FOR SEVERABILITY; REPEALING ALL ',-- CONFLICTING ORDINANCES; PROVIDING FOR A PENALTY; PROVIDING FOR PUBLICATION; AND \ ESTABLISHING AN EFFECTIVE DATE. ," BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOSr TEXAS: SECTION 1. that the definition of livestock in section 3-1 be amended to read as follows: LIVESTOCK: Includes horses r mules r donkeys r cattIer sheepr goatsr swiner except miniature swiner and all similar domestic animalsr whether kept for use or pleasure. SECTION 2. That the following be added to Section 3-1 after the definition of "Livestock": MINIATURE SWINE: Any swine that has been bred to attain a maximum shoulder height of 18 inches and a maximum weight of 90 pounds. SECTION 3. That Section 3-11 be amended to read as follows: Sec. 3-11. Licenses Required. I i (a) The owner of any dog r cat or miniature swine over four (4) months of age and residing within the city shall obtain a license annually for the animal in compliance with this article. (b) No dog or cat shall be licensed unless it has a current rabies vaccination as prescribed by Section 3-57 of this chapter. (c) No miniature swine shall be licensed unless it has a current rabies vaccinationr a current erysipelas vaccine and a current veterinarianrs statement verifying the animalrs size. SECTION 4. That Section 3.40 be amended as follows: Sec. 3-40 Restraint of doqs and miniature swine; public nuisance animals. (a) No owner or handler of a dog or miniature swine shall fail to keep such animal under ¡ restraint at all times. SECTION 5. That Section 3-41(a) r Section 3-41(b) (1) r Section 3-41(b) (2) and Section 3-42 be amended by adding the words IIMiniatùre Swine," before the word dog. SECTION 6. That Section 3-45 be amended as follows: Sec. 3 -45 Keepinq of miniature swine , doqs and cats; prohibition of swine.
