CIJ-S CITY LIMITS I AND PROVIDING REGULATIONS; <br />lL';¡f ;:E 5b CHANGING THE WORD HOGS TO SWINE; PROVIDING FOR <br />Q RABIES TESTING AND QUARANTINE; SETTING FEES; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL <br />',-- CONFLICTING ORDINANCES; PROVIDING FOR A <br />PENALTY; PROVIDING FOR PUBLICATION; AND <br />\ ESTABLISHING AN EFFECTIVE DATE. <br />," <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOSr <br />TEXAS: <br /> <br />SECTION 1. that the definition of livestock in section 3-1 <br />be amended to read as follows: <br /> <br />LIVESTOCK: Includes horses r mules r donkeys r <br />cattIer sheepr goatsr swiner except miniature <br />swiner and all similar domestic animalsr <br />whether kept for use or pleasure. <br /> <br />SECTION 2. That the following be added to Section 3-1 after <br />the definition of "Livestock": <br /> <br />MINIATURE SWINE: Any swine that has been bred <br />to attain a maximum shoulder height of 18 <br />inches and a maximum weight of 90 pounds. <br /> <br />SECTION 3. That Section 3-11 be amended to read as follows: <br /> <br />Sec. 3-11. Licenses Required. <br />I <br />i (a) The owner of any dog r cat or miniature <br />swine over four (4) months of age and residing <br />within the city shall obtain a license <br />annually for the animal in compliance with <br />this article. <br /> <br />(b) No dog or cat shall be licensed unless it <br />has a current rabies vaccination as prescribed <br />by Section 3-57 of this chapter. <br /> <br />(c) No miniature swine shall be licensed <br />unless it has a current rabies vaccinationr a <br />current erysipelas vaccine and a current <br />veterinarianrs statement verifying the <br />animalrs size. <br /> <br />SECTION 4. That Section 3.40 be amended as follows: <br /> <br />Sec. 3-40 Restraint of doqs and miniature swine; <br />public nuisance animals. <br /> <br />(a) No owner or handler of a dog or miniature <br />swine shall fail to keep such animal under <br />¡ restraint at all times. <br /> <br />SECTION 5. That Section 3-41(a) r Section 3-41(b) (1) r Section <br />3-41(b) (2) and Section 3-42 be amended by adding the words <br />IIMiniatùre Swine," before the word dog. <br /> <br />SECTION 6. That Section 3-45 be amended as follows: <br /> <br />Sec. 3 -45 Keepinq of miniature swine , doqs and <br />cats; prohibition of swine. <br /> <br />(a) No person shall abandon a miniature swiner dog <br />or cat upon moving out of residential premises <br />occupied by the person.
