<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING 4.83 ACRES,
<br />MORE OR LESS, OF LAND AREA, BEING A PORTION OF
<br />BLOCK 10 AND ALL OF BLOCK 11 OF THE D.S. COMBS
<br />ADDITION, CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS, AS RECORDED IN VOLUME 42, PAGE 332 OF
<br />THE HAYS COUNTY DEED RECORDS, LOCATED IN THE
<br />500 AND 600 BLOCKS OF THE SOUTHEAST SIDE OF
<br />VALLEY STREET FROM "M" SINGLE-FAMILY, DUPLEX,
<br />AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-1"
<br />SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY)
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on February 23, 1993, the Joint Planning and Zoning
<br />Commissions of the city of San Marcos held a public hearing
<br />regarding a request to change the zoning from "M" Single-Family,
<br />Duplex, and Neighborhood Business District to "R-l" single-Family
<br />Dwelling District (Low Density) for 4.5 acres (subsequently
<br />surveyed at 4.83 acres, more or less) of land area being a portion
<br />of Block 10 and all of Block 11 of the D.S. Combs Addition, City of
<br />San Marcos, Hays County, Texas, as recorded in Volume 42, Page 332
<br />of the Hays County Deed Records, located in the 500 and 600 Blocks
<br />of the Southeast side of Valley Street; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commissions did, on February 23, 1993 consider the request and
<br />voted to approve it and has recommended that the request be
<br />approved by the City Council of the city; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the 10th
<br />day of May, 1993, regarding the request; and,
<br />
<br />,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the city of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION 1. That the Official Zoning Map of the city, as
<br />described in section 3 of the General Zoning Ordinance, is hereby
<br />amended to rezone the following described real property located in
<br />San Marcos, Hays County, Texas, which is presently zoned "M"
<br />Single-Family, Duplex, and Neighborhood Business District to "R-1"
<br />Single-Family Dwelling District (Low Density):

<br />DESCRIPTION OF 4.83 ACRES, MORE OR LESS, OF LAND AREA
<br />BEING A PORTION OF BLOCK 10 AND ALL OF BLOCK 11 OF THE
<br />D.S. COMBS ADDITION, CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS, AS RECORDED IN VOLUME 42, PAGE 332 OF THE HAYS
<br />COUNTY DEED RECORDS, AND BEING MORE PARTICULARLY
<br />DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
<br />
<br />COMMENCING at an 1/2" iron rod set with an aluminum cap
<br />for the west corner of said Block 10 at the intersection
<br />of the southeast line of Valley Street and the northeast
<br />line of Jackman Street, being the west corner of that
<br />tract of land described in a deed from pinkie Lee Dowell
<br />to the city of San Marcos dated December 6, 1977 and
<br />recorded in Volume 303, Page 872 of the Hays County Deed
<br />Records;
