<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING O. 371
<br />ACRES, MORE OR LESS, OF LAND AREA BEING A
<br />PORTION OF BLOCK 10 OF THE D.S. .COMBS
<br />ADDITION, CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS AS RECORDED IN VOLUME 42, PAGE 332 OF
<br />THE HAYS COUNTY DEED RECORDS, BEING ALL OF
<br />THAT TRACT OF LAND DESCRIBED IN A DEED FROM
<br />PINKIE LEE DOWELL TO THE CITY OF SAN MARCOS
<br />DATED DECEMBER 6, 1977 AND RECORDED IN VOLUME
<br />303, PAGE 872 OF THE HAYS COUNTY DEED RECORDS
<br />TOGETHER WITH ALL OF THAT TRACT OF LAND
<br />DESCRIBED IN A DEED FROM JOSE MONTELONGO ET UX
<br />TO. THE CITY OF SAN MARCOS DATED MARCH 5, 1976
<br />AND RECORDED IN VOLUME 282, PAGE 517 OF THE
<br />HAYS COUNTY DEED RECORDS, LOCATED AT 401
<br />JACKMAN STREET, FROM "M" SINGLE-FAMILY, DUPLEX
<br />AND NEIGHBORHOOD BUSINESS DISTRICT TO "P"
<br />PUBLIC AND INSTITUTIONAL DISTRICT AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on January 5,1993, the Zoning commission of the city
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "Mil Single-Family, Duplex and Neighborhood Business
<br />District to "P" Public and Institutional District for 0.371 acres,
<br />more or less, of land area being a portion of Block 10 of the D.S.
<br />Combs Addition, City of San Marcos, Hays County, Texas as recorded
<br />in Volume 42, Page 332 of the Hays County Deed Records, being all
<br />of that tract of land described in a deed from pinkie Lee Dowell to
<br />the city of San Marcos dated December 6, 1977 and recorded in
<br />Volume 303, Page 872 of the Hays County Deed Records and together
<br />with all of that tract of land described in a deed from Jose
<br />Montelongo et ux to the city of San Marcos dated March 5, 1976 and
<br />recorded in Volume 282, Page 517 of the Hays County Deed Records,
<br />located at 401 Jackman Street; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on January 5, 1993 consider the request and voted
<br />to approve it and has recommended that the request be approved by
<br />the City Council of the City; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the lOth
<br />day of May, 1993, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the city Council hereby finds and determines that the
<br />adoption of the. following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION 1. That the' Official Zoning Map of the City, as
<br />described in Section 3 of the General Zoning Ordinance is hereby
<br />amended to rezone the following described real property located in
<br />San Marcos, Hays County, Texas, which is presently zoned "Mn
<br />Single-Family, Duplex and Neighborhood Business District to liP"
<br />Public and Institutional District:
