<br /> . . . <br /> - ' . 5 <br /> CITY OF SAN MARCOS, TEXAS <br /> SAN MARCOS ELECTRIC UTILITY <br /> SUPPLEMENT AL <br /> ELECTRIC SERVICE AGREEMENT <br /> THIS AGREEMENT, is made and entered into by and between the City of San Marcos, <br /> ---- Texas, a municipal corporation (hereinafter the "City") and Southwest Texas State University <br /> : (hereinafter the "Customer") this 20tltJayof May, 1993. <br /> <br /> WHEREAS, the City has developed and adopted a special retail electric rate schedule <br /> applicable to electric service provided by City to supplement the electric power and energy <br /> requirements of customers owning and operating electric generation equipment located on <br /> their premises, subject to a special contract for such service; and <br /> WHEREAS, the Customer has installed a cogeneration facility located on Customer's <br /> premises at the corner of Live Oak and Pecan Streets, San Marcos, Texas and desires to <br /> contract with the City for the purchase of electric power and energy to supplement the <br /> electric power and energy requirements supplied by the Customer's cogeneration facility; and <br /> WHEREAS, the City agrees to provide such supplemental electric service to the <br /> Customer pursuant to the rates and charges and terms and conditions of the City's <br /> Supplemental Electric Service Rate Schedule COG and the terms" and conditions of this <br /> Agreement. <br /> NOW THEREFORE, in consideration of the foregoing premises and the mutual <br /> undertakings herein contained, the parties agree as follows: <br /> I ARTICLE I <br /> DEFINITIONS <br /> I ' <br /> For the purposes of this Agreement, the terms set forth below are defined as follows: <br /> . <br /> "Agreement" refers to this Supplemental Electric Service Agreement, which includes as <br /> Exhibit A the Supplemental Electric Service Rate Schedule COG. <br /> "City" refers to the City of San Marcos, Texas. <br /> "City System" refers to the electric utility system operated by the Electric Utility Department <br /> of the City of San Marcos. <br /> "Customer" refers to Southwest Texas State University. <br />
