<br /> .' <br /> S-A <br /> CITY OF SAN MARCOS, TEXAS <br /> Supplemental Electric Service Agreement Page 2 <br /> "Delivery Point" refers to the point of electrical interconnection between the facilities of the <br /> City and the facilities of the Customer designated by the City as the "Main Campus" or <br /> "Cogeneration" delivery point. <br /> ~'- <br /> "Director" refers to the Director of the City Electric Utility Department. <br /> "Facility" refers to the Customer's Cogeneration Facilities with a nominally rated electric <br /> power output of 6,000 kilowatts located on the Customer's premises where the Customer's <br /> electric power and energy requirements are provided by the City through the Delivery Point. <br /> "Good Utility Practices" refers to the practices, methods and acts (including but not limited <br /> to the practices~ 'methods and acts engaged in or approved by a significant portion of the <br /> electric utility industry) that, at a particular time, in the exercise of reasonable judgment in <br /> light of the facts known or that should have been known at the time a decision was made, <br /> would have been expected to accomplish the desired result in a manner consistent with law, <br /> regulation, reliability, safety, environmental protection, economy and expedition. <br /> "LCRA" refers to the Lower Colorado River Authority which is the City's present bulk power <br /> supplier pursuant to rates and charges approved by the Public Utility tommission of Texas. <br /> "Loss Factor" refers to the factor applied to the metered kW demands and kWh energy <br /> deliveries to Customer to account for the level of electrical losses between the point of <br /> delivery of City's bulk power requirements to City System and the Delivery Point. <br /> "Parties" refers to the signatories to this Agreement. <br /> "PUCT" refers to the Public Utility Commission of Texas. <br /> I <br /> "Rules & Regulations" refers to the Citv of San Marcos. Electric Utility Rules and Requlations. <br /> "Schedule COG" refers to the City's applicable retail electric rate schedule Supplemental <br /> Electric Service Rate Schedule COG. . . <br /> "Schedule WP-1" refers to the applicable electric rate schedule of LCRA pursuant to which <br /> the City purchases wholesale electric service for resale. <br /> "Small Power Production and/or Cogeneration Facilities" refers to any small (as defined by the <br /> Public Utilities Regulatory Policies Act or "PURPA") power production facility or cogeneration <br /> facility located within the City's service territory or connected directly to the City System. <br /> "Supplemental Electric Service" refers to all of the electric power and energy supplied to <br /> Customer by City at the Delivery Point pursuant to Schedule COG and this Agreement. <br /> - <br />
