:;6 CITY OF SAN MARCOS, TEXAS Supplemental Electric Service Agreement Page 3 ARTICLE II TERM, TERMINATION AND NOTICES 2.1 This Agreement shall be effective as of the date first above written and shall remain in full force and effect except as provided in Article 2.2 of this Agreement. 2.2 Either Party may terminate this Agreement effective on and after October 1, 1998, with at least one (1) year advance written notice to the other Party; provided, that in the case of any such notice given to the City by the Customer more than twelve (12) months prior to the effective date of termination specified in such notice, the Customer shall have the right to withdraw such notice at least twelve (12) months prior to the effective date of termination previously specified in such notice of termination. 2.3 Notwithstanding any other right or remedy provided hereunder and as an additional right and remedy, in the event the Customer fails or refuses to pay any monthly bill in accordance with the provisions of this Agreement and Schedule COG the City shall have the right, upon thirty (30) days written notice to Customer, to refuse to deliver or supply electric service until Customer has made such payment. 2.4 Any notices required by this Agreement shall be sent by U.S. mail, postage prepaid, electronic means or courier. Kellam Building, Room 114 San Marcos, Texas 78666 Any change of address by one Party shall be furnished promptly to the other Party and shall not constitute an amendment to this Agreement.
